AB722-ASA1,1,2 1An Act to repeal 15.107 (16) and 16.08; and to create 15.107 (16) and 16.08 of
2the statutes; relating to: creating an environmental science council.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB722-ASA1, s. 1 3Section 1. 15.107 (16) of the statutes is created to read:
AB722-ASA1,1,114 15.107 (16) Environmental science council. There is created in the
5department of administration an environmental science council. The council shall
6consist of 9 members who are nonpartisan and who have demonstrated expertise in
7at least one of the following: the engineering sciences, economic sciences, biological
8sciences, physical sciences, human medical sciences or statistical or risk assessment
9sciences. The governor shall designate one member as chairperson and one member
10as vice chairperson. The members shall be nominated by the governor, and with the
11advice and consent of the senate appointed, for 3-year terms.
AB722-ASA1, s. 2 12Section 2. 15.107 (16) of the statutes, as created by 1995 Wisconsin Act .... (this
13act), is repealed.
AB722-ASA1, s. 3 14Section 3. 16.08 of the statutes is created to read:

116.08 Environmental science council. (1) In this section, "agency" means
2any office, department, agency, institution of higher education, association, society
3or other body in state government created or authorized to be created by the
4constitution or any law which is entitled to expend moneys appropriated by law,
5including the legislature and the courts, and any authority created under ch. 231 or
6234.
AB722-ASA1,2,8 7(2) At the request of the governor, the environmental science council shall do
8any of the following:
AB722-ASA1,2,109 (a) Advise on issues affecting the protection and management of the
10environment and natural resources in this state.
AB722-ASA1,2,1211 (b) Evaluate proposed rules that establish environmental or natural resources
12standards or other criteria.
AB722-ASA1,2,1413 (c) Review the scientific and technical adequacy of environmental programs,
14guidelines, methodologies, protocols and tests.
AB722-ASA1,2,1615 (d) Recommend any scientific standard or other criteria for protection of human
16health and the environment that the council determines is appropriate.
AB722-ASA1,2,1917 (e) Review new information needs, the adequacy of data collection and analysis
18and the quality of agency environmental plans or programs of research, development
19and demonstration.
AB722-ASA1,2,2020 (f) Assess the importance of natural and anthropogenic sources of pollution.
AB722-ASA1,2,2121 (g) Perform any other advisory duty requested by the governor.
AB722-ASA1,2,23 22(3) On its own initiative or at the request of any agency, the council may
23perform any duty under sub. (2).
AB722-ASA1,3,2 24(4) In performing its duties under sub. (2), the council shall be strictly
25nonpartisan, shall consult and work closely with agencies, shall use sound, objective

1and scientific reasoning, shall assess the relative risk to human health and the
2environment and shall consider economic consequences.
AB722-ASA1,3,10 3(5) The council may create any committee necessary to carry out the council's
4duties under sub. (2). If the council creates a committee under this subsection, the
5council shall appoint members to the committee who have the scientific and technical
6expertise to carry out the purpose of the committee. The council may appoint council
7members and citizens to a committee, but the council shall appoint one council
8member to serve as chairperson of each committee created under this subsection. If
9the council appoints citizens to a committee, the council shall appoint citizens who
10have the scientific and technical expertise to carry out the purpose of the committee.
AB722-ASA1,3,12 11(6) All agencies shall fully cooperate with and assist the council and any
12committee created by the council under sub. (5).
AB722-ASA1, s. 4 13Section 4. 16.08 of the statutes, as created by 1995 Wisconsin Act .... (this act),
14is repealed.
AB722-ASA1, s. 5 15Section 5. Nonstatutory provisions.
AB722-ASA1,3,2216 (1)  Initial terms of members of environmental science council.
17Notwithstanding the length of terms of the members of the environmental science
18council specified under section 15.107 (16) of the statutes, as created by this act, 3
19members initially appointed to the council shall be appointed for a term expiring on
20July 1, 1997, 3 members initially appointed to the council shall be appointed for a
21term expiring on July 1, 1998, and 3 members initially appointed to the council shall
22be appointed for a term expiring on July 1, 1999.
AB722-ASA1, s. 6 23Section 6. Effective dates. This act takes effect on the day after publication,
24except as follows:

1(1) The repeal of sections 15.107 (16) and 16.08 of the statutes takes effect on
2December 31, 2000.
