SENATE SUBSTITUTE AMENDMENT 1, To 1995 ASSEMBLY BILL 841

AB841-SSA1,1,2 An Act to amend chapter 942 (title); and to create 942.08 of the statutes; relating to: criminal invasion of privacy and providing a penalty.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB841-SSA1, s. 1 Section 1. Chapter 942 (title) of the statutes is amended to read:

AB841-SSA1,1,6 CRIMES AGAINST REPUTATIOn, Privacy AND CIVIL LIBERTIES

AB841-SSA1, s. 2 Section 2. 942.08 of the statutes is created to read:

AB841-SSA1,1,8 942.08 Invasion of privacy. (1) In this section:

AB841-SSA1,1,13 (a) "Nude or partially nude person" means any human being who has less than fully and opaquely covered genitals, pubic area or buttocks, any female human being who has less than a fully opaque covering over any portion of a breast below the top of the nipple, or any male human being with covered genitals in a discernibly turgid state.

AB841-SSA1,2,3 (b) "Surveillance" means the observation, photographing, filming or videotaping of the activities of another person without the knowledge and consent of that person.

AB841-SSA1,2,7 (c) "Surveillance device" means any device, instrument, apparatus, implement, mechanism or contrivance used, designed to be used or primarily intended to be used to engage in surveillance, including a peep hole or similar method of direct sight observation.

AB841-SSA1,2,10 (2) Whoever knowingly installs or uses a surveillance device in any place for the purpose of engaging in surveillance of any nude or partially nude person is guilty of a Class E felony.
