(3m) Notwithstanding sub. (3), an adult day care center, an adult family
5home, an assisted living facility, a community-based residential facility, a home
6health agency, a hospice, a nursing home or a treatment facility may employ an
7individual on the condition that the receipt of information from the department of
8justice does not indicate that the individual has been convicted of intentional abuse
9or intentional neglect under s. 940.295 (3) (a) 1. or reckless abuse or reckless neglect
10under s. 940.295 (3) (a) 2. and has not been pardoned for the violation resulting in
11the conviction.".

14(1b) Prior convictions of certain employes. The treatment of section 50.065
15of the statutes first applies to individuals who are hired by an adult day care center,
16an adult family home, an assisted living facility, a community-based residential
1facility, a home health agency, a hospice, a nursing home or a treatment facility on
2the effective date of this subsection.".
