SENATE AMENDMENT 1, To 1995 SENATE BILL 177

SB177-SA1,1,1 At the locations indicated, amend the bill as follows:

SB177-SA1,1,3 1. Page 1, line 2: after "prisoners" insert: "and review of the establishment of certain programs involving manufacturing of products by prisoners".

SB177-SA1,1,4 2. Page 1, line 3: delete lines 3 to 7 and substitute:

SB177-SA1,1,5 " Section 1g. 303.015 (1) (e) of the statutes is created to read:

SB177-SA1,1,10 303.015 (1) (e) 1. At the request of the department, the board shall review and either approve or deny a proposed plan under s. 303.06 (5) to allow a tax-supported institution or a nonprofit agency to sell in the open market products manufactured in whole or in part by inmates in a state penal institution as part of a hobby-craft program or vocational training.

SB177-SA1,1,14 2. The board may suspend a plan under s. 303.06 (5) that it approved under subd. 1. At the request of the department, the board shall review and either approve or deny a proposal by the department to reinstate a plan that the board suspended under this subdivision.

SB177-SA1, s. 1r Section 1r. 303.055 of the statutes is created to read:

SB177-SA1,2,13 303.055 Prison manufacturing; approval. (1) Except as provided in sub. (2), before establishing any hobby-craft, vocational training or other program in which prisoners will engage in the manufacture of products, the department shall provide written notification of its proposed action to the cochairpersons of the joint committee on finance. If the cochairpersons of the committee do not notify the department that the committee has scheduled a meeting for the purpose of reviewing the proposed program within 14 working days after the date of the department's written notification to the committee, the program may be established as proposed by the department. If, within 14 working days after the date of the department's written notification to the committee, the cochairpersons of the committee notify the department that the committee has scheduled a meeting for the purpose of reviewing the proposed program, the program may be established only upon approval of the committee.

SB177-SA1,2,15 (2) Subsection (1) does not apply to a prison industry established under s. 303.01 or to any correctional farm operation.".

SB177-SA1,2,17 3. Page 2, line 3: after "purpose" insert: "and if the sale of the products is approved by the prison industries board under s. 303.015 (1) (e)".
