SB292-SA1,1,11 At the locations indicated, amend the bill as follows:
SB292-SA1,1,3 21. Page 1, line 5: after "property" insert: "and providing liability in situations
3involving recklessness".
SB292-SA1,1,4 42. Page 2, line 5: after that line insert:
SB292-SA1,1,5 5" Section 1m. 895.52 (3) (intro.) of the statutes is amended to read:
SB292-SA1,1,86 895.52 (3)Liability; state property. (intro.) Subsection (2) does not limit the
7liability of an officer, employe or agent of this state or of any of its agencies for either
8any of the following:".
SB292-SA1,1,9 93. Page 2, line 13: after that line insert:
SB292-SA1,1,10 10" Section 2g. 895.52 (3) (c) of the statutes is created to read:
SB292-SA1,2,211 895.52 (3) (c) A death or injury which occurs on property designated by the
12department of natural resources under s. 23.115 or designated by another state
13agency for a recreational activity if the officer, employe or agent who caused the death
14or injury intentionally did an act, or intentionally failed to do an act that is his or her
15duty to another to do, knowing or having reason to know of facts which would lead
16a reasonable person to realize not only that his or her conduct creates an

1unreasonable risk of physical harm to another but also that that risk is substantially
2greater than that which is necessary to make his or her conduct negligent.
SB292-SA1, s. 2m 3Section 2m. 895.52 (4) (intro.) of the statutes is amended to read:
SB292-SA1,2,74 895.52 (4)Liability; property of governmental bodies other than this state.
5(intro.) Subsection (2) does not limit the liability of a governmental body other than
6this state or any of its agencies or of an officer, employe or agent of such a
7governmental body for either any of the following:".
