(4g) Any ordinance or resolution enacted or adopted under this section
4permitting immobilization of a motor vehicle shall provide that, if a motor vehicle not
5subject to immobilization under sub. (2) is erroneously or improperly immobilized
6pursuant to the ordinance or resolution by the local authority or, if the local authority
7contracts with a person to immobilize motor vehicles subject to immobilization under
8sub. (2), by that person, the local authority or other person who erroneously or
9improperly immobilized the motor vehicle is liable to the owner of the motor vehicle
10for the cost of any alternative transportation resulting from the immobilization of the
11motor vehicle until the immobilization device is removed, but not to exceed $25.".
