AB5-ASA1,1,4 1An Act to renumber 94.69; to amend 93.01 (10); and to create 94.69 (2) of the
2statutes; relating to: the authority of the department of agriculture, trade and
3consumer protection to prohibit the use of atrazine in a specified area in the
4town of North Lancaster, Grant County.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB5-ASA1, s. 1 5Section 1. 93.01 (10) of the statutes is amended to read:
AB5-ASA1,1,126 93.01 (10) "Pests" include any living stage of insects, mites, nematodes, slugs,
7snails or other invertebrate animals injurious to plants, plant products, animals and
8humans; any bacteria, fungi, other parasitic plants or reproductive parts thereof,
9viruses, mycoplasma, protozoans or infectious substances which cause disease in or
10damage to plants or plant products; any host upon which a plant pest is dependent
11for the completion of all or a portion of its life cycle; and any other living organism
12classified as a pest under s. 94.69 (1) (a).

1Section 2. 94.69 of the statutes is renumbered 94.69 (1).
AB5-ASA1, s. 3 2Section 3. 94.69 (2) of the statutes is created to read:
AB5-ASA1,2,143 94.69 (2) (a) Notwithstanding sub. (1) (i) and ss. 160.19 and 160.21, the
4department may not promulgate a rule prohibiting the use of atrazine in part or all
5of the area described in par. (b), based on a sample of groundwater taken before the
6effective date of this paragraph .... [revisor inserts date], with a concentration of total
7chlorinated atrazine residue that attains or exceeds the enforcement standard if the
8concentration of total chlorinated atrazine residue in a subsequent sample of
9groundwater from the same sampling point is less than the enforcement standard,
10except that the department may promulgate a rule prohibiting the use of atrazine
11in part or all of the area described in par. (b) based on a sample of groundwater taken
12after the effective date of this paragraph .... [revisor inserts date], in which the
13concentration of total chlorinated atrazine residue attains or exceeds the
14enforcement standard.
AB5-ASA1,2,1815 (b) Paragraph (a) applies to an area in the town of North Lancaster, Grant
16County, described as follows: SE-1/4 of Sec. 7, S-1/2 of Sec. 8, SW-1/4 of Sec. 9, W-1/2
