AB611-ASA1,1,2 An Act to create 174.02 (4) of the statutes; relating to: liability for damages caused by dogs used to perform law enforcement functions.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB611-ASA1, s. 1 Section 1. 174.02 (4) of the statutes is created to read:

AB611-ASA1,1,5 174.02 (4) Law enforcement dogs. (a) In this subsection, "law enforcement agency" has the meaning given in s. 165.83 (1) (b).

AB611-ASA1,1,8 (b) The owner of a dog that is used by a law enforcement agency is not liable under sub. (1) for damages caused by the dog to a crime suspect while the dog is performing law enforcement functions.

AB611-ASA1,1,11 (c) Subsection (2) does not apply to the owner of a dog that is used by a law enforcement agency if the dog injures a crime suspect while the dog is performing law enforcement functions.

AB611-ASA1,2,3 (d) Subsection (3) does not apply to a dog that is used by a law enforcement agency if the dog injures a crime suspect while the dog is performing law enforcement functions.
