ASSEMBLY SUBSTITUTE AMENDMENT 1,
To 1997 ASSEMBLY JOINT RESOLUTION 12

AJR12-ASA1,1,4 1To amend section 4 (1), (3) and (5) of article VI; and to create section 4 (6) of article
2VI of the constitution; relating to: 4-year terms of office for, appointment of,
3vacancies in the offices of, and the restriction on holding any other office by,
4sheriffs and clerks (1st consideration).
AJR12-ASA1,1,5 5Resolved by the assembly, the senate concurring, That:
AJR12-ASA1, s. 1 6Section 1. Section 4 (1), (3) and (5) of article VI of the constitution are amended
7to read:
AJR12-ASA1,1,118 [Article VI] Section 4 (1) Sheriffs Except as provided in sub. (2), coroners,
9registers of deeds, district attorneys, and all other elected county officers except
10judicial officers, sheriffs, clerks and chief executive officers, shall be chosen by the
11electors of the respective counties once in every 2 years.
AJR12-ASA1,1,1212 (3) (a) Sheriffs shall may not hold no any other partisan office.
AJR12-ASA1,1,14 13(b) Sheriffs may be required by law to renew their security from time to time,
14and in default of giving such new security their office shall be deemed vacant.

1(c) Beginning with the first general election at which the governor is elected
2which occurs after the ratification of this paragraph, sheriffs and clerks shall be
3chosen by the electors of the respective counties once in every 4 years.
AJR12-ASA1,2,74 (5) All vacancies in the offices of sheriff, coroner, register of deeds or district
5attorney shall be filled by appointment. The person appointed to fill a vacancy shall
6hold office only for the unexpired portion of the term to which appointed and until
7a successor shall be elected and qualified.
AJR12-ASA1, s. 2 8Section 2. Section 4 (6) of article VI of the constitution is created to read:
AJR12-ASA1,2,119 [Article VI] Section 4 (6) When a vacancy occurs in the office of sheriff or clerk,
10the vacancy shall be filled by appointment of the governor, and the person appointed
11shall serve until his or her successor is elected and qualified.
AJR12-ASA1,2,14 12Be it further resolved, That this proposed amendment be referred to the
13legislature to be chosen at the next general election and that it be published for 3
14months previous to the time of holding such election.
