SENATE AMENDMENT 1, TO 1997 SENATE BILL 335

SB335-SA1,1,1 At the locations indicated, amend the bill as follows:

SB335-SA1,1,7 1. Page 1, line 10: before "and" insert "grants for technical assistance and training in the use of educational technology; subsidized loans for upgrading and installing electrical and computer network wiring; purchases of certain educational technology hardware and software; the educational telecommunications access program; providing an exemption from emergency rule procedure; granting rule-making authority".

SB335-SA1,1,12 44.72 (1) (d) Promulgate rules establishing administrative procedures, eligibility and application requirements and criteria for awarding grants under this subsection.

SB335-SA1, s. 2r Section 2r. 44.72 (4) (a) of the statutes, as created by 1997 Wisconsin Act 27, is amended to read:

SB335-SA1,2,10 44.72 (4) (a) Subsidized loans authorized. The board may make subsidized loans under this subsection to school districts from the proceeds of public debt contracted under s. 20.866 (2) (zc) and to public library boards from the proceeds of public debt contracted under s. 20.866 (2) (zcm). Subsidized loans under this subsection may be used only for the purpose of upgrading the electrical wiring of school and library buildings in existence on the effective date of this paragraph .... [revisor inserts date], and installing and upgrading computer network wiring in accordance with rules promulgated by the board.".

SB335-SA1,2,17 196.218 (4r) (c) 5. Include the protections specified in s. 196.209 (4) (a) and (b). Before promulgating the rules required under this subdivision, the commission shall consult with the telecommunications privacy council appointed under s. 196.209 (5) (a).

SB335-SA1, s. 9101 Section 9101. Nonstatutory provisions; administration.

SB335-SA1,2,19 (1) Rules relating to educational technology training grants.

SB335-SA1,3,2 (a) Subject to paragraph (b), the technology for educational achievement in Wisconsin board shall use the procedure under section 227.24 of the statutes to promulgate the rules required under section 44.72 (1) (d) of the statutes, as created by this act, for a period but not to exceed the period authorized under section 227.24 (1) (c) and (2) of the statutes. Notwithstanding section 227.24 (1) (a) and (2) (b) of the statutes, the board need not provide evidence of the necessity of preserving the public peace, health, safety or welfare in promulgating the rules under this paragraph.

SB335-SA1,3,11 (b) The board shall submit the proposed rules under paragraph (a ) to the cochairpersons of the joint committee on information policy. If the cochairpersons of the committee do not notify the board that the committee has scheduled a meeting for the purpose of reviewing the proposed rules within 14 working days after the date of the board's submittal, the board may proceed to promulgate the rules. If, within 14 working days after the date of the board's submittal, the cochairpersons of the committee notify the board that the committee has scheduled a meeting for the purpose of reviewing the proposed rules, the board shall not promulgate the rules until the committee approves the rules.

SB335-SA1,3,12 (2) Rules relating to educational technology infrastructure loans.

SB335-SA1,3,20 (a) Subject to paragraph (b), the technology for educational achievement in Wisconsin board shall use the procedure under section 227.24 of the statutes to promulgate the rules required under section 44.72 (4) (a) of the statutes, as affected by this act, for the period before permanent rules take effect, but not to exceed the period authorized under section 227.24 (1) (c) and (2) of the statutes. Notwithstanding section 227.24 (1) (a) and (2) (b) of the statutes, the board need not provide evidence of the necessity of preserving the public peace, health, safety or welfare in promulgating the rules under this paragraph.

SB335-SA1,4,4 (b) The board shall submit the proposed rules under paragraph (a ) to the cochairpersons of the joint committee on information policy. If the cochairpersons of the committee do not notify the board that the committee has scheduled a meeting for the purpose of reviewing the proposed rules within 14 business days after the date of the board's submittal, the board may proceed to promulgate the rules. If, within 14 business days after the date of the board's submittal, the cochairpersons of the committee notify the board that the committee has scheduled a meeting for the purpose of reviewing the proposed rules, the board shall not promulgate the rules until the committee approves the rules.

SB335-SA1,4,25 (3) Educational technology hardware and software purchases. The technology for educational achievement in Wisconsin board shall use the procedure under section 227.24 of the statutes to propose emergency rules establishing standards and specifications for purchases of educational technology hardware and software by school districts, cooperative educational service agencies, technical college districts and the board of regents of the University of Wisconsin System under section 44.71 (2) (g) of the statutes. Prior to promulgation of emergency rules under this subsection, the technology for educational achievement in Wisconsin board shall submit the proposed emergency rules to the cochairpersons of the joint committee on finance. If the cochairpersons of the committee do not notify the board that the committee has scheduled a meeting for the purpose of reviewing the proposed emergency rules within 14 working days after the date of the board's submittal, the board shall promulgate the emergency rules as proposed by the board. If, within 14 working days after the date of the board's submittal, the cochairpersons of the committee notify the board that the committee has scheduled a meeting for the purpose of reviewing the proposed emergency rules, the board shall promulgate the emergency rules only upon approval of the committee. Notwithstanding section 227.24 (1) (a) and (2) (b) of the statutes, the board need not provide evidence of the necessity of preserving the public peace, health, safety or welfare in promulgating rules under this subsection. Notwithstanding section 227.24 (3) of the statutes, no statement is required to be filed with such emergency rules.".

SB335-SA1,5,2 " Section 9141. Nonstatutory provisions; public service commission.

SB335-SA1,5,15 (1) The public service commission shall submit the rules that it proposes to promulgate under 1997 Wisconsin Act 27, section 9141 (1) (a), to the cochairpersons of the joint committee on information policy and to the cochairpersons of the joint committee on finance. If the cochairpersons of the committees do not notify the commission that one or both of the committees has scheduled a meeting for the purpose of reviewing the proposed rules within 14 working days after the date of the commission's submittal, the commission may proceed to promulgate the rules. If, within 14 working days after the date of the commission's submittal, the cochairpersons of either committee notify the commission that the committee has scheduled a meeting for the purpose of reviewing the proposed rules, the commission shall not promulgate the rules until that committee approves the rules. The public service commission shall submit the proposed rules to the committees under this subsection no later than the 60th day after the effective date of this subsection.".
