ASSEMBLY AMENDMENT 1, TO ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 1997 SENATE BILL 57

SB57-ASA1-AA1,1,1 At the locations indicated, amend the substitute amendment as follows:

SB57-ASA1-AA1,1,2 1. Page 3, line 24: delete that line and substitute "section:".

SB57-ASA1-AA1,1,3 2. Page 4, line 1: before that line insert:

SB57-ASA1-AA1,1,4 "(a) "Farmer" has the meaning given is s. 340.01 (18) (b).

SB57-ASA1-AA1,1,5 (b) "Farm premises" has the meaning given in s. 102.04 (3).

SB57-ASA1-AA1,1,6 (c) "Hazardous material" has the meaning given in 49 USC 5102 (2).".

SB57-ASA1-AA1,1,7 3. Page 4, line 22: after that line insert:

SB57-ASA1-AA1,1,8 "(7m) This section does not apply to any of the following:

SB57-ASA1-AA1,1,11 (a) The transportation of hazardous material in a vehicle controlled by a farmer and operated by a farmer or farm employe when the hazardous material is to be used on the farm premises to which it is transported.

SB57-ASA1-AA1,2,6 (b) Fertilizer and agricultural chemical retailers' transportation of hazardous material while exclusively engaged in the delivery of fertilizer and agricultural chemicals when the delivery is from the retailer's place of business directly to a farm premises within a 50-mile radius of the retailer's place of business and the hazardous materials are fertilizer and agricultural chemicals for use on the farm premises to which they are delivered.".
