1An Act to repeal and recreate 943.012 (intro.) of the statutes;
relating to:
2criminal damage to certain property and providing a penalty.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1. 943.012 (intro.) of the statutes, as affected by 1999 Wisconsin Act
4.... (Assembly Bill 465), is repealed and recreated to read:

5943.012 Criminal damage to or graffiti on religious and other property. 6(intro.) Whoever intentionally causes damage to, intentionally marks, draws or
7writes with ink or another substance on or intentionally etches into any physical
8property of another, without the person's consent and with knowledge of the
9character of the property, is guilty of a Class H felony if the property consists of one
10or more of the following:

Reconciliation provision. The treatment of section 943.012 (intro.) of the
2statutes by this act and
Section 4 (1), (2
) and (3) of this act are void unless the
3treatment of sections 939.50 (1) (h) and (3) (h) and 943.012 (intro.) of the statutes by
41999 Assembly Bill 465 is enacted into law before July 1, 2000, in exactly the same
5form as it appears in sections 236, 245 and 390 of 1999 Assembly Bill 465.

The treatment of section 943.012 (intro.) of the statutes first applies to
8offenses occurring on the effective date of this subsection.

Effective dates. This act takes effect on the day after publication,
10except as follows:

If 1999 Assembly Bill 465 has been enacted on or before the day after
12publication of this act and the treatment of section 943.012 (intro.) of the statutes by
131999 Assembly Bill 465 took effect on or before the day after publication of this act,
14then the treatment of section 943.012 (intro.) of the statutes by this act and
Section 153 (1
) of this act take effect on the day after publication of this act.

If 1999 Assembly Bill 465 has been enacted on or before the day after
17publication of this act and the treatment of section 943.012 (intro.) of the statutes by
181999 Assembly Bill 465 takes effect after the day after publication of this act, then
19the treatment of section 943.012 (intro.) of the statutes by this act and
Section 3 (1)
20of this act take effect on the date that the treatment of section 943.012 (intro.) of the
21statutes by 1999 Assembly Bill 465 takes effect.

If 1999 Assembly Bill 465 is enacted after the day after publication of this
23act but before July 1, 2000, the treatment of section 943.012 (intro.) of the statutes
1by this act and
Section 3 (1) of this act take effect on the date that the treatment of
2section 943.012 (intro.) of the statutes by 1999 Assembly Bill 465 takes effect.
