TO 1999 ASSEMBLY BILL 466

AB466-ASA1,1,3 1An Act to amend 301.46 (5) (a) (intro.); and to create 301.46 (2s) of the statutes;
2relating to: releasing information from the sex offender registry to certain
3schools.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB466-ASA1, s. 1 4Section 1. 301.46 (2s) of the statutes is created to read:
AB466-ASA1,1,75 301.46 (2s) Release of information to parents through school district
6administrators.
(a) In this subsection, "school district administrator" has the
7meaning given in s. 115.001 (8).
AB466-ASA1,1,118 (b) 1. A parent, guardian or legal custodian of a child enrolled in a school district
9may request the school district administrator to make a request for information
10under par. (c) concerning persons subject to bulletin notification under sub. (2m)
11(am).

12. A parent, guardian or legal custodian of a child enrolled in a private school
2may request the school district administrator of the school district in which the child
3resides or the school district administrator of the school district in which the private
4school is located to make a request for information under par. (c) concerning persons
5subject to bulletin notification under sub. (2m) (am).
AB466-ASA1,2,126 3. If a parent, guardian or legal custodian of a child intends to move to a new
7residence that is located in a different school district or intends to enroll his or her
8child in a private school, the parent, guardian or legal custodian may request the
9school district administrator of the school district in which the new residence is
10located or the school district administrator of the school district in which the private
11school is located to make a request for information under par. (c) concerning persons
12subject to bulletin notification under sub. (2m) (am).
AB466-ASA1,2,1813 (c) When a school district administrator receives a request from a parent,
14guardian or legal custodian under par. (b) for information concerning persons
15required to register under s. 301.45, the school district administrator shall request
16information concerning the persons from the police chief of the community in which
17the school district is located or the sheriff of the county in which the school district
18is located.
AB466-ASA1,2,2319 (d) Upon receiving a request from a school district administrator under par. (c),
20the police chief or sheriff shall immediately provide in writing all of the following
21information concerning each person who is residing, employed or attending school
22in the community or county and about whom the police chief or sheriff has received
23notification under sub. (2m) (am):

12. Information sufficient to identify the person, including date of birth, gender,
2race, height, weight and hair and eye color.
AB466-ASA1,3,53 3. The statute that the person violated, the date of conviction, adjudication or
4commitment, and the county or, if the state is not this state, the state in which the
5person was convicted, adjudicated or committed.
AB466-ASA1,3,66 4. The address at which the person is residing.
AB466-ASA1,3,77 5. The name and address of the place at which the person is employed.
AB466-ASA1,3,88 6. The name and location of any school in which the person is enrolled.
AB466-ASA1,3,119 7. A description of any motor vehicle that the person owns or that is registered
10in the person's name, including the information provided by the person under s.
11301.45 (2) (a) 7.
AB466-ASA1,3,1212 8. The most recent date on which the information under s. 301.45 was updated.
AB466-ASA1,3,1513 (e) Upon receiving information from a police chief or sheriff under par. (d), a
14school district administrator shall in turn provide the information in writing to the
15parent, guardian or legal custodian who requested the information.
AB466-ASA1,3,1816 (f) 1. A parent, guardian or legal custodian of a child who makes a request for
17information under par. (b) may also make a request for information under sub. (5)
18concerning a person required to register under s. 301.45.
AB466-ASA1,3,2119 2. A public or private elementary or secondary school administrator who makes
20a request for information under par. (c) may also make a request for information
21under sub. (4) for information concerning persons registered under s. 301.45.
AB466-ASA1, s. 2 22Section 2. 301.46 (5) (a) (intro.) of the statutes is amended to read:
AB466-ASA1,4,323 301.46 (5) (a) (intro.) The department or a police chief or sheriff may provide
24the information specified in par. (b) concerning a specific person required to register
25under s. 301.45 to a person who is not provided notice or access under subs. sub. (2)

1to, (2m), (3) or (4) if, in the opinion of the department or the police chief or sheriff,
2providing the information is necessary to protect the public and if the person
3requesting the information does all of the following:
