ASSEMBLY SUBSTITUTE AMENDMENT 1,
TO 1999 ASSEMBLY BILL 731

AB731-ASA1,1,3 1An Act to amend 20.435 (3) (km), 46.515 (2), 46.515 (3) (a) and 46.515 (4) (a) 4m.;
2and to create 49.175 (1) (ze) 11. and 49.175 (1) (ze) 12. of the statutes; relating
3to:
child abuse and neglect prevention and making appropriations.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB731-ASA1, s. 1 4Section 1. 20.435 (3) (km) of the statutes, as affected by 1999 Wisconsin Act
59
, section 397r, is amended to read:
AB731-ASA1,1,96 20.435 (3) (km) Federal block grant transfer; aids. The amounts in the schedule
7for grants under ss. 46.515 (2), 46.95 (2), 46.99 (2) (a), and 46.995 (2), (3) (b) and (4m)
8(b). All moneys transferred from the appropriation account under s. 20.445 (3) (md)
9shall be credited to this appropriation account.
AB731-ASA1, s. 2 10Section 2. 46.515 (2) of the statutes is amended to read:
AB731-ASA1,2,1811 46.515 (2) Funds provided. If a county or Indian tribe applies and is selected
12by the department under sub. (5) to participate in the program under this section,

1the department shall award, from the appropriation appropriations under s. 20.435
2(3) (de) and (km), a grant annually to be used only for the purposes specified in sub.
3(4) (a) and (am). The minimum amount of a grant is $10,000. The department shall
4determine the amount of a grant awarded to a county, other than a county with a
5population of 500,000 or more, or Indian tribe in excess of the minimum amount
6based on the number of births that are funded by medical assistance under subch.
7IV of ch. 49 in that county or the reservation of that Indian tribe in proportion to the
8number of births that are funded by medical assistance under subch. IV of ch. 49 in
9all of the counties and the reservations of all of the Indian tribes to which grants are
10awarded under this section in the year in which the county or Indian tribe is first
11selected to participate in the program
. The department shall determine the amount
12of a grant awarded to a county with a population of 500,000 or more in excess of the
13minimum amount based on 60% of the number of births that are funded by medical
14assistance under subch. IV of ch. 49 in that county in proportion to the number of
15births that are funded by medical assistance under subch. IV of ch. 49 in all of the
16counties and the reservations of all of the Indian tribes to which grants are awarded
17under this section in the year in which the county is first selected to participate in
18the program
.
AB731-ASA1, s. 3 19Section 3. 46.515 (3) (a) of the statutes is amended to read:
AB731-ASA1,2,2320 46.515 (3) (a) Number selected. In the 1997-99 Beginning in state fiscal
21biennium year 2000-01, no more than 6 20 rural counties, 3 9 urban counties and
222 5 Indian tribes may be selected by the department to participate in the program
23under this section.
AB731-ASA1, s. 4 24Section 4. 46.515 (4) (a) 4m. of the statutes is amended to read:

146.515 (4) (a) 4m. Other than in a county with a population of 500,000 or more,
2to reimburse a case management provider under s. 49.45 (25) (b) for the amount of
3the allowable charges under the medical assistance program that is not provided by
4the federal government for case management services provided to a medical
5assistance beneficiary described in s. 49.45 (25) (am) 9. who is a child and who is a
6member of a family that receives home visitation program services under par. (b) 1.
7or to reimburse a case management provider as permitted under the temporary
8assistance for needy families program, 42 USC 601 to 619
.
AB731-ASA1, s. 5 9Section 5. 49.175 (1) (ze) 11. of the statutes is created to read:
AB731-ASA1,3,1110 49.175 (1) (ze) 11. `Child abuse and neglect prevention grants.' For child abuse
11and neglect prevention grants under s. 46.515 (2), $2,158,000 in each fiscal year.
AB731-ASA1, s. 6 12Section 6. 49.175 (1) (ze) 12. of the statutes is created to read:
AB731-ASA1,3,1813 49.175 (1) (ze) 12. `Child abuse and neglect prevention technical assistance.'
14For technical assistance under s. 46.515 (8) to counties and Indian tribes that are
15selected to participate in the child abuse and neglect prevention program under s.
1646.515, $261,000 in fiscal year 2000-01. The department may not distribute moneys
17allocated under this subdivision unless the joint committee on finance approves the
18distribution.
AB731-ASA1, s. 7 19Section 7. Nonstatutory provisions; legislature.
AB731-ASA1,4,1320 (1) Child abuse and neglect prevention technical assistance. The
21department of health and family services may request the joint committee on finance
22to supplement, from the appropriation under section 20.865 (4) (m) of the statutes,
23the appropriation account under section 20.445 (3) (mc) of the statutes to pay for
24technical assistance to counties and tribes that are selected to participate in the child
25abuse and neglect prevention program under section 46.515 of the statutes, as

1affected by this act. If the department of health and family services makes that
2request, it shall submit a plan to the joint committee on finance to expend not more
3than $261,000 in fiscal year 2000-01 for that technical assistance. Notwithstanding
4section 13.101 (3) of the statutes, if, within 14 working days after the date of the
5request and the submission of the plan, the cochairpersons of the committee do not
6notify the secretary of health and family services that the committee has scheduled
7a meeting for the purpose of reviewing the request and plan, the request and plan
8shall be considered approved and the appropriation account under section 20.445 (3)
9(mc) of the statutes shall be supplemented from the appropriation under section
1020.865 (4) (m) of the statutes in the amount requested. If the appropriation account
11under section 20.445 (3) (mc) of the statutes is supplemented under this subsection,
12the department of workforce development shall transfer the amount of the
13supplement to the appropriation account under section 20.435 (3) (kx) of the statutes.
AB731-ASA1, s. 8 14Section 8. Appropriation changes; health and family services.
AB731-ASA1,4,2015 (1) Child abuse and neglect prevention grants. In the schedule under section
1620.005 (3) of the statutes for the appropriation to the department of health and family
17services under section 20.435 (3) (km) of the statutes, as affected by the acts of 1999,
18the dollar amount is increased by $2,158,000 for fiscal year 2000-01 to increase
19funding for grants under the child abuse and neglect program under section 46.515
20of the statutes, as affected by this act.
AB731-ASA1, s. 9 21Section 9. Effective date.
AB731-ASA1,4,2322 (1) Child abuse and neglect prevention grants. This act takes effect on July
231, 2000.
