ASSEMBLY AMENDMENT 1, TO 2003 ASSEMBLY BILL 137

AB137-AA1,1,1 At the locations indicated, amend the bill as follows:

AB137-AA1,1,2 1. Page 3, line 20: after that line insert:

AB137-AA1,1,5 "(c) When ordering that a defendant be placed in a senior court program, the court may order that the record be expunged if the defendant satisfies the conditions of the order and any applicable suspended prosecution agreement.".

AB137-AA1,1,7 2. Page 4, line 4: delete lines 4 to 6 and substitute "any applicable suspended prosecution agreement, the court shall do all of the following:

AB137-AA1,1,8 1. Discharge the defendant.

AB137-AA1,1,10 2. Dismiss the charges against the defendant if a judgment of conviction was not previously entered.

AB137-AA1,1,12 3. Expunge the court record if the court authorized expungement under sub. (2) (c).".
