TO 2003 ASSEMBLY BILL 144

AB144-ASA1,1,3 1An Act to renumber and amend 14.035; and to create 14.035 (2) and 14.035
2(3) of the statutes; relating to: negotiation and modification of Indian gaming
3compacts.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB144-ASA1, s. 1 4Section 1. 14.035 of the statutes is renumbered 14.035 (1) and amended to
5read:
AB144-ASA1,1,76 14.035 (1) The Subject to subs. (2) and (3), the governor may, on behalf of this
7state, enter into any compact that has been negotiated under 25 USC 2710 (d).
AB144-ASA1, s. 2 8Section 2. 14.035 (2) of the statutes is created to read:
AB144-ASA1,1,129 14.035 (2) The governor may not enter into, amend, extend, or renew any
10compact negotiated under sub. (1) containing terms that in any way condition which
11gaming activities may be conducted under the compact based on gaming activities
12that are conducted in Canada.

1Section 3. 14.035 (3) of the statutes is created to read:
AB144-ASA1,2,102 14.035 (3) If the governor enters into, amends, extends, or renews any compact
3negotiated under sub. (1) that is for a period longer than 15 years, the
4co-chairpersons of the joint committee of finance or the Indian tribe or band,
5beginning after the end of the 15th year but before the start of the 2nd year before
6the expiration of the compact, whichever is earlier, may request that the governor
7meet with the Indian tribe or band to seek modifications to the compact. The
8governor shall notify the joint committee on finance of any modification to the
9compact and any such modification shall be renegotiated upon the expiration,
10amendment, extension, or renewal of the compact.
