ASSEMBLY AMENDMENT 1, TO 2003 ASSEMBLY BILL 766

AB766-AA1,1,1 At the locations indicated, amend the bill as follows:

AB766-AA1,1,2 1. Page 2, line 1: delete lines 1 to 7 and substitute:

AB766-AA1,1,3 " Section 1g. 175.40 (1) (d) of the statutes is created to read:

AB766-AA1,1,5 175.40 (1) (d) "University police" means the University of Wisconsin System police under s. 36.11 (2).

AB766-AA1, s. 1m Section 1m. 175.40 (5) (a) of the statutes is renumbered 175.40 (5) (a) 1. and amended to read:

AB766-AA1,1,12 175.40 (5) (a) 1. For Subject to subd. 2., for any county having a population of 500,000 or more, if any law enforcement officer has territorial jurisdiction that is wholly or partially within that county and has authority to arrest a person within the officer's territorial jurisdiction, the officer may arrest that person anywhere in the county.

AB766-AA1, s. 1r Section 1r. 175.40 (5) (a) 2. of the statutes is created to read:

AB766-AA1,2,4 175.40 (5) (a) 2. If a university police officer has law enforcement responsibilities for a campus in a particular county and authority to arrest a person on campus, the officer may arrest the person elsewhere in the county, but only within a municipality with which the university police has an agreement under par. (d).".

AB766-AA1,2,6 2. Page 2, line 15: delete "University of Wisconsin System" and substitute "university".

AB766-AA1,2,7 3. Page 2, line 18: delete lines 18 to 21 and substitute:

AB766-AA1,2,9 " Section 3m. 175.40 (5) (d) (intro.) of the statutes is renumbered 175.40 (5) (d) and amended to read:

AB766-AA1,2,16 175.40 (5) (d) In order to allow its officers to exercise authority under par. (a) 1., a law enforcement agency for a municipality or county must adopt and implement written policies regarding the arrest authority under this subsection , including at least all of the following:. In order to allow its officers to exercise authority in a municipality under par. (a) 2., the university police must enter into an agreement with the law enforcement agency for the municipality that establishes written policies regarding the arrest authority of university police under this subsection.

AB766-AA1, s. 3n Section 3n. 175.40 (5) (d) 1., 2., 3. and 4. of the statutes are renumbered 175.40 (5) (dm) 1., 2., 3. and 4.

AB766-AA1, s. 4m Section 4m. 175.40 (5) (dm) (intro.) of the statutes is created to read:

AB766-AA1,2,21 175.40 (5) (dm) (intro.) Written policies regarding arrest authority under par. (d) shall cover at least all of the following:".
