AB861-ASA2-AA1,1,1 At the locations indicated, amend the substitute amendment as follows:

AB861-ASA2-AA1,1,2 1. Page 44, line 4: delete "The" and substitute "Subject to s. 980.085 (1), the".

AB861-ASA2-AA1,1,3 2. Page 46, line 2: after "and" insert ", subject to s. 980.085,".

AB861-ASA2-AA1,1,4 3. Page 47, line 18: after that line insert:

AB861-ASA2-AA1,1,5 " Section 104m. 980.085 of the statutes is created to read:

AB861-ASA2-AA1,1,9 980.085 Limitation on certain placements. (1) The court may not authorize supervised release for a person under s. 980.07 (7) (d) on or after the effective date of this subsection .... [revisor inserts date], if the person being placed on supervised release will reside in a municipality to which all of the following apply:

AB861-ASA2-AA1,1,11 (a) The municipality is located in a county with a population that exceeds 500,000.

AB861-ASA2-AA1,2,2 (b) The total number of persons incarcerated at any facility located in the municipality exceeds 1 percent of the municipality's population.

AB861-ASA2-AA1,2,6 (2) The department may not, on or after the effective date of this subsection .... [revisor inserts date], change the placement of a person who is on supervised release under s. 980.06, 1997 stats., or s. 980.08 (6m), 2001 stats., or s. 980.08 to a residence that is in a municipality to which sub. (1) (a) and (b) apply.".
