SENATE AMENDMENT 3, TO 2003 SENATE BILL 14

SB14-SA3,1,1 At the locations indicated, amend the bill as follows:

SB14-SA3,1,2 1. Page 6, line 13: delete lines 13 to 21 and substitute:

SB14-SA3,1,3 " Section 13m. 942.08 (2) (d) of the statutes is created to read:

SB14-SA3,1,5 942.08 (2) (d) Enters another person's private property without that person's consent and looks into any individual's dwelling unit if all of the following apply:

SB14-SA3,1,8 1. The actor looks into the dwelling unit for the purpose of sexual arousal or gratification and with the intent to intrude upon or interfere with an individual's privacy.

SB14-SA3,1,10 2. The actor looks into a part of the dwelling unit in which an individual is present.

SB14-SA3,1,12 3. The individual has a reasonable expectation of privacy in that part of the dwelling unit.

SB14-SA3,2,2 4. The individual does not consent to the actor looking into that part of the dwelling.

SB14-SA3, s. 14m Section 14m. 942.08 (2) (e) of the statutes is created to read:

SB14-SA3,2,5 942.08 (2) (e) Enters another person's private property without that person's consent and looks into any individual's dwelling unit if all of the following apply:

SB14-SA3,2,8 1. The actor looks into the dwelling unit for the purpose of sexual arousal or gratification and with the intent to intrude upon or interfere with an individual's privacy.

SB14-SA3,2,9 2. The actor looks into a part of the dwelling unit in which no one is present.

SB14-SA3,2,11 3. If an individual were present, he or she would have a reasonable expectation of privacy in that part of the dwelling unit.".
