ASSEMBLY AMENDMENT 1, TO 2005 ASSEMBLY BILL 1056

AB1056-AA1,1,1 At the locations indicated, amend the bill as follows:

AB1056-AA1,1,2 1. Page 7, line 9: delete lines 9 to 25.

AB1056-AA1,1,3 2. Page 8, line 1: delete lines 1 to 8.

AB1056-AA1,1,8 3. Page 18, line 3: after "shall" insert "have a general right of direction and control over a covered employee, which right may be shared with the client to the degree necessary to allow the client to conduct its business, meet any fiduciary responsibilities, or comply with any applicable regulatory or statutory requirements, but".

AB1056-AA1,1,12 4. Page 18, line 13: delete lines 13 to 15 and substitute "employees to the degree necessary to conduct the client's business, to meet the client's fiduciary responsibilities, or to comply with any applicable regulatory or statutory requirements.".

AB1056-AA1,2,2 5. Page 18, line 19: after "responsible" insert "for setting the rate of pay for a covered employee, whether or not through negotiations;".

AB1056-AA1,2,11 6. Page 18, line 20: delete lines 20 to 23 and substitute "or salary to a covered employee from its own accounts; for withholding, collecting, reporting, and remitting payroll taxes on behalf of a covered employee; for the unemployment insurance coverage of a covered employee, for filing all required unemployment insurance reports, for paying all required unemployment insurance contributions or reimbursements due on the wages of a covered employee, and for otherwise complying with all provisions of ch. 108 that are applicable to employers on behalf of the client; and for establishing, funding, and administering employee benefits for a covered employee; except that the".
