ASSEMBLY SUBSTITUTE AMENDMENT 1,
TO 2005 ASSEMBLY BILL 603

AB603-ASA1,1,4 1An Act to renumber 38.10 (2) (a); to amend 38.08 (1) (a) 1., 38.08 (2m), 38.10
2(1) (intro.) and 38.10 (2) (d) 1.; and to create 38.10 (2) (ag) and 38.10 (3) of the
3statutes; relating to: the appointment a student member to each technical
4college district board.

Currently, the technical college system is managed on the local level by district
boards consisting of nine members in each of the state's 16 technical college districts.
The members of the technical college district board for each district are appointed
by an appointment committee consisting of local elected officials in accordance with
a representation plan based upon population distribution within the district,
including distribution of women and minorities. All members of district boards must
be residents of the district. Two members must be employers and two members must
be employees. One member must be a school district administrator of a school
district that lies within the technical college district. All members serve for
three-year terms.
This substitute amendment adds to each district board a student member. The
student must be enrolled at least half-time and in good academic standing at the
technical college and be at least 18 years old. Under the substitute amendment, the
student member is selected by the students enrolled in the technical college
according to procedures prescribed by the state technical college system board.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB603-ASA1, s. 1 1Section 1. 38.08 (1) (a) 1. of the statutes is amended to read:
AB603-ASA1,2,82 38.08 (1) (a) 1. A district board shall administer the district and shall be
3composed of 9 10 members who are residents of the district, including 2 employers,
42 employees, 3 additional members, a school district administrator, as defined under
5s. 115.001 (8), and one elected official who holds a state or local office, as defined in
6s. 5.02, and a student enrolled at least half-time and in good academic standing at
7the technical college who is at least 18 years old
. The board shall by rule define
8"employer" and "employee" for the purpose of this subdivision.
AB603-ASA1, s. 2 9Section 2. 38.08 (2m) of the statutes is amended to read:
AB603-ASA1,2,1310 38.08 (2m) Any member of a district board serving as an elected official under
11sub. (1) (a) 1. shall cease to be a member upon vacating his or her office as an elected
12official. The student member of the district board shall cease to be a member if he
13or she loses the status upon which the appointment was based.
AB603-ASA1, s. 3 14Section 3. 38.10 (1) (intro.) of the statutes is amended to read:
AB603-ASA1,2,1615 38.10 (1) (intro.) District board members other than the student member shall
16be appointed by an appointment committee constituted as follows:
AB603-ASA1, s. 4 17Section 4. 38.10 (2) (a) of the statutes is renumbered 38.10 (2) (am).
AB603-ASA1, s. 5 18Section 5. 38.10 (2) (ag) of the statutes is created to read:
AB603-ASA1,2,2019 38.10 (2) (ag) This subsection does not apply to the appointment of the student
20member of the district board.
AB603-ASA1, s. 6 21Section 6. 38.10 (2) (d) 1. of the statutes is amended to read:

138.10 (2) (d) 1. Upon receiving notice of the vacancy or term expiration under
2par. (a) (am) 1. and at least 14 days before publication of the notice required under
3subd. 3., the appointment committee shall publish a notice announcing the intent to
4appoint district board members, including the criteria for selection, and soliciting the
5submission of names and qualifications of candidates.
AB603-ASA1, s. 7 6Section 7. 38.10 (3) of the statutes is created to read:
AB603-ASA1,3,97 38.10 (3) The student member of the district board shall be selected by the
8students enrolled in the district in accordance with procedures prescribed by the
9board.
AB603-ASA1,3,1510 (b) The board shall review the selection of the student member to determine
11whether it complies with the requirements of s. 38.08 (1) (a). If the board determines
12that the selection does not comply, the board shall notify the district board. Within
1345 days after receipt of the notice a student member of the district board who does
14meet the requirements under s. 38.08 (1) (a) shall be selected by the students enrolled
15in the district in accordance with procedures prescribed by the board.
AB603-ASA1,3,1916 (c) The board shall review any selections made under par. (b). If the board
17determines that a selection does not comply with the requirements under s. 38.08 (1)
18(a), the board shall appoint the student member of the district board in accordance
19with s. 38.08 (1) (a).
