SENATE AMENDMENT 2, TO SENATE SUBSTITUTE AMENDMENT 1, TO 2005 SENATE BILL 147

SB147-SSA1-SA2,1,1 At the locations indicated, amend the substitute amendment as follows:

SB147-SSA1-SA2,1,3 1. Page 1, line 4: delete "preemption" and substitute "the state minimum wage and preemption".

SB147-SSA1-SA2,1,4 2. Page 3, line 11: delete lines 11 to 24 and substitute:

SB147-SSA1-SA2,1,6 " Section 6g. 104.04 of the statutes is renumbered 104.04 (1) and amended to read:

SB147-SSA1-SA2,2,7 104.04 (1) The Subject to sub. (2), the department shall investigate, ascertain, determine, and fix such reasonable classifications, and shall impose general or special orders, determining the living-wage living wage, and shall carry out the purposes of ss. 104.01 to 104.12 this chapter. Such investigations, classifications, and orders shall be made as provided under s. 103.005, and the penalties specified in s. 103.005 (12) shall apply to and be imposed for any violation of ss. 104.01 to 104.12 this chapter. In determining the living-wage living wage the department may consider the effect that an increase in the living-wage living wage might have on the economy of the state, including the effect of a living-wage living wage increase on job creation, retention, and expansion, on the availability of entry-level jobs, and on regional economic conditions within the state. The department may not establish a different minimum wage for men and women. Said orders shall be subject to review in the manner provided in ch. 227.

SB147-SSA1-SA2, s. 6m Section 6m. 104.04 (2) of the statutes is created to read:

DWD 272.03 (1) (a) or (b) or (1m) (a) or (b), 272.05 (1) (a) or (b), 272.07 (3) (a) 1., 2., or 3. or (b) 1., 2., or 3., or 272.08, Wis. Adm. Code, or increase an allowance for board and lodging under s. DWD 272.03 (3) (a) 1. or 2. or (b) 1. or 2. or (3m) (a) 1. or 2. or (b) 1. or 2., or 272.05 (2) (a) or (b), Wis. Adm. Code, after the effective date of this subsection .... [revisor inserts date].".
