ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 2007 ASSEMBLY BILL 296

AB296-ASA1,1,4 An Act to renumber and amend 29.173 (2) (b); to amend 29.194 (title), 29.194 (1) (title) and 29.194 (1) (b); and to create 29.173 (2) (b) 1., 29.173 (2) (b) 2. and 29.194 (1) (c) of the statutes; relating to: issuing hunting, trapping, and fishing approvals to certain members of the U.S. armed forces.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB296-ASA1, s. 1 Section 1. 29.173 (2) (b) of the statutes is renumbered 29.173 (2) (b) (intro.) and amended to read:

AB296-ASA1,2,2 29.173 (2) (b) (intro.) A qualified service member holding a current resident deer hunting license may hunt deer of either sex with a firearm during any season open to hunting of deer with firearms that is established by the department. In this paragraph, "qualified service member" means For purposes of this paragraph, a qualified service member is a member of the armed forces who exhibits proof that he or she is a resident, is in active service with the armed forces outside this state and is on furlough or leave. proof of one of the following:

AB296-ASA1, s. 2 Section 2. 29.173 (2) (b) 1. of the statutes is created to read:

AB296-ASA1,2,4 29.173 (2) (b) 1. That he or she is a resident who is on furlough or leave.

AB296-ASA1, s. 3 Section 3. 29.173 (2) (b) 2. of the statutes is created to read:

AB296-ASA1,2,7 29.173 (2) (b) 2. That he or she was a resident at the time he or she entered active service and that he or she is on furlough or leave.

AB296-ASA1, s. 4 Section 4. 29.194 (title) of the statutes is amended to read:

AB296-ASA1,2,10 29.194 (title) Approvals for students and members of the armed forces or reserves.

AB296-ASA1, s. 5 Section 5. 29.194 (1) (title) of the statutes is amended to read:

AB296-ASA1,2,13 29.194 (1) (title) Certain resident licenses may be issued to students and members of the armed forces or reserves.

AB296-ASA1, s. 6 Section 6. 29.194 (1) (b) of the statutes is amended to read:

AB296-ASA1,2,23 29.194 (1) (b) The department shall treat a qualified member of the armed forces or a qualified member of a reserve unit of the U.S. armed forces as a resident for purposes of determining the member's eligibility for and cost of obtaining a hunting, trapping, or fishing approval under this subchapter chapter. A qualified member of the armed forces is a person who exhibits proof that he or she is in active service in the U.S. armed forces or in forces incorporated in the U.S. armed forces and that he or she is stationed in this state. A qualified member of a reserve unit of the U.S. armed forces is a person who exhibits proof that he or she is a member of a reserve unit of the U.S. armed forces located in this state.

AB296-ASA1, s. 7 Section 7. 29.194 (1) (c) of the statutes is created to read:

AB296-ASA1,3,5 29.194 (1) (c) In addition to being able to qualify under par. (b), for purposes of qualifying for a resident hunting or fishing approval, a member of the armed forces not stationed this state or a member of a reserve unit of the U.S. armed forces not located in this state shall be treated as a resident if the member was a resident at the time he or she entered active service.
