SB116-SA2,1,11 At the locations indicated, amend the bill as follows:
SB116-SA2,1,2 21. Page 2, line 1: before that line insert:
SB116-SA2,1,3 3" Section 1d. 20.395 (5) (ek) of the statutes is amended to read:
SB116-SA2,1,64 20.395 (5) (ek) Safe-ride grant program; state funds. From the general fund,
5all moneys transferred from the appropriation account under s. 20.435 (6) (hx)
6received under s. 346.655 (2) (am) for the purpose of awarding grants under s. 85.55.
SB116-SA2, s. 1g 7Section 1g. 20.435 (6) (hx) of the statutes is amended to read:
SB116-SA2,2,78 20.435 (6) (hx) Services related to drivers, receipts. The amounts in the
9schedule for services related to drivers. All moneys received by the secretary of
10administration from the driver improvement surcharge on court fines and
11forfeitures authorized under s. 346.655 and all moneys transferred from the
12appropriation account under s. 20.395 (5) (di) shall be credited to this appropriation.
13The secretary of administration shall annually transfer to the appropriation account

1under s. 20.395 (5) (ek) 3.76% of all moneys credited to this appropriation from the
2driver improvement surcharge.
Any unencumbered moneys in this appropriation
3account may be transferred to sub. (7) (hy) and ss. 20.255 (1) (hm), 20.285 (1) (ia),
420.395 (5) (ci) and (di), and 20.455 (5) (h) by the secretary of administration, after
5consultation with the secretaries of health and family services and transportation,
6the superintendent of public instruction, the attorney general, and the president of
7the University of Wisconsin System.".

SB116-SA2,2,9 93. Page 4, line 3: after that line insert:
SB116-SA2,2,10 10" Section 7e. 346.655 (1) of the statutes is amended to read:
SB116-SA2,2,1811 346.655 (1) If a court imposes a fine or a forfeiture for a violation of s. 346.63
12(1) or (5), except for a first violation of s. 346.63 (1) (b), if the person who committed
13the violation had a blood alcohol concentration of 0.08 or more but less than 0.1 at
14the time of the violation, or a local ordinance in conformity therewith, or s. 346.63
15(2) or (6) or 940.25, or s. 940.09 where the offense involved the use of a vehicle, it shall
16impose a driver improvement surcharge under ch. 814 in an amount of $355 $365 in
17addition to the fine or forfeiture, plus costs, fees, and other surcharges imposed under
18ch. 814.
SB116-SA2, s. 7j 19Section 7j. 346.655 (2) (a) of the statutes is amended to read:
SB116-SA2,2,2420 346.655 (2) (a) Except as provided in par. (b), the clerk of court shall collect and
21transmit $350 of the amount paid by each person under sub. (1) to the county
22treasurer as provided in s. 59.40 (2) (m). The county treasurer shall then make
23payment of 38.5% of the amount $350 to the secretary of administration as provided
24in s. 59.25 (3) (f) 2.

1Section 7n. 346.655 (2) (am) of the statutes is created to read:
SB116-SA2,3,42 346.655 (2) (am) The clerk of circuit court or the municipal court shall collect
3and transmit $15 of the amount paid by each person under sub. (1) to the
4appropriation account under s. 20.395 (5) (ek).
SB116-SA2, s. 7r 5Section 7r. 346.655 (2) (b) of the statutes is amended to read:
SB116-SA2,3,116 346.655 (2) (b) If the forfeiture is imposed by a municipal court, the court shall
7transmit $350 of the amount paid by each person to the treasurer of the county, city,
8town, or village, and that treasurer shall make payment of 38.5% of the amount $350
9to the secretary of administration as provided in s. 66.0114 (1) (bm). The treasurer
10of the city, town, or village shall transmit the remaining 61.5% of the amount $350
11to the treasurer of the county.".
