SENATE AMENDMENT 1, TO SENATE SUBSTITUTE AMENDMENT 1, TO 2007 SENATE BILL 308

SB308-SSA1-SA1,1,1 At the locations indicated, amend the substitute amendment as follows:

SB308-SSA1-SA1,1,2 1. Page 3, line 11: after that line insert:

SB308-SSA1-SA1,1,3 " Section 2g. 173.13 (1) (a) 8. of the statutes is amended to read:

SB308-SSA1-SA1,1,5 173.13 (1) (a) 8. An animal mistreated in violation of ch. 951 or of the rules promulgated under s. 173.35 (6).

SB308-SSA1-SA1, s. 2r Section 2r. 173.21 (1) (a) of the statutes is amended to read:

SB308-SSA1-SA1,1,9 173.21 (1) (a) There are reasonable grounds to believe that the owner has mistreated the animal in violation of ch. 951 or of the rules promulgated under s. 173.35 (6).".

The department shall request a criminal history search from the records maintained by the department of justice for a person who submits an application for a license under this subsection. If the person is not a resident of this state, or if at any time within the 3 years preceding the date of the application the person has not been a resident of this state, or if the department determines that the person's employment, licensing, or state court records provide a reasonable basis for further investigation, the department shall make a good faith effort to obtain from any state or other United States jurisdiction in which the person is a resident or was a resident within the 3 years preceding the date of the application information that is relevant to the determination under subd. 2.

SB308-SSA1-SA1,2,24 2. The department may not issue a license to a person under this subsection if the department determines that the person has been convicted of a violation of ch. 951 or of an offense that would have been a violation of ch. 951 if it had been committed in this state.

SB308-SSA1-SA1,3,2 (d) A person to whom the department issues a license under this subsection shall prominently display the license at the location for which it was issued.".
