SENATE SUBSTITUTE AMENDMENT 1,
TO 2007 SENATE BILL 454

SB454-SSA1,1,3 1An Act to create 346.94 (6) and 346.95 (4m) of the statutes; relating to: the
2operation on highways of motor vehicles and recreational trailers with aquatic
3plants attached and providing a penalty.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB454-SSA1, s. 1 4Section 1. 346.94 (6) of the statutes is created to read:
SB454-SSA1,1,55 346.94 (6) Operation of vehicles; aquatic plants. (a) In this subsection:
SB454-SSA1,1,66 1. "Law enforcement officer" has the meaning given in s. 23.33 (1) (ig).
SB454-SSA1,1,77 2. "Personal watercraft" has the meaning given in s. 30.50 (9d).
SB454-SSA1,1,98 3. "Recreational trailer" means a trailer designed for carrying a boat or
9personal watercraft.
SB454-SSA1,1,1110 (b) No person may operate a motor vehicle or a recreational trailer on a highway
11if any aquatic plants are attached to any of the following:
SB454-SSA1,1,1212 1. The exterior of the motor vehicle or recreational trailer.
SB454-SSA1,2,1
12. The tires of the motor vehicle or recreational trailer.
SB454-SSA1,2,32 3. The exterior of any boat or personal watercraft being carried upon the
3recreational trailer.
SB454-SSA1,2,54 (c) Any law enforcement officer may, with respect to any aquatic plants
5attached in violation of par. (b), do any of the following:
SB454-SSA1,2,76 1. Require the operator of the motor vehicle or recreational trailer to remove
7and appropriately dispose of the aquatic plants.
SB454-SSA1,2,108 2. Prohibit the operator of the motor vehicle or recreational trailer from
9proceeding until the aquatic plants have been removed and appropriately disposed
10of.
SB454-SSA1,2,1211 (d) No person may fail or refuse to comply with any requirement or directive
12of a law enforcement officer under par. (c).
SB454-SSA1, s. 2 13Section 2. 346.95 (4m) of the statutes is created to read:
SB454-SSA1,2,1714 346.95 (4m) Any person violating s. 346.94 (6) (d) shall be fined not less than
15$50 nor more than $250. There is no penalty for a violation of s. 346.94 (6) (b), and
16the general penalty provision under s. 939.61 does not apply a violation of s. 346.94
17(6) (b).
