ASSEMBLY AMENDMENT 2, TO ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 2009 ASSEMBLY BILL 496

AB496-ASA1-AA2,1,1 At the locations indicated, amend the substitute amendment as follows:

AB496-ASA1-AA2,1,4 1. Page 1, line 2: delete "messaging and electronic mail messaging" and substitute "messaging, electronic mail messaging, and communicating verbally on a cellular telephone".

AB496-ASA1-AA2,1,6 2. Page 2, line 4: after "message" insert "or while communicating verbally on a cellular telephone".

AB496-ASA1-AA2,1,7 3. Page 2, line 14: after that line insert:

AB496-ASA1-AA2,1,12 "4. Communicating verbally on a cellular telephone if the cellular telephone or any accessory of the cellular telephone allows the person to talk and listen without holding the cellular telephone or accessory and the person does not hold or touch the cellular telephone or accessory while driving the vehicle, except as necessary to initiate or terminate a call.".

AB496-ASA1-AA2,1,13 4. Page 2, line 15: delete lines 15 to 18 and substitute:

AB496-ASA1-AA2,2,2 " Section 2m. 346.95 (5) of the statutes is amended to read:

AB496-ASA1-AA2,2,4 346.95 (5) Any person violating s. 346.89 (3) or 346.94 (13) may be required to forfeit not more than $200.".
