TO 2009 SENATE BILL 331

SB331-SA4,1,11 At the locations indicated, amend the bill as follows:
SB331-SA4,1,4 21. Page 2, line 2: after "provided" insert "; withholding child care subsidy
3payments under Wisconsin Works pending a hearing on a matter and limiting the
4time for making a decision;".
SB331-SA4,1,5 52. Page 21, line 12: after that line insert:
SB331-SA4,1,6 6" Section 36p. 49.155 (5m) of the statutes is created to read:
SB331-SA4,1,107 49.155 (5m) Administrative hearings. If an individual receiving a child care
8subsidy under this section requests an administrative hearing on a matter relating
9to the program under this section, notwithstanding subch. III of ch. 227 all of the
10following apply with respect to the hearing:
SB331-SA4,1,1211 1. The hearing examiner may allow the individual who requested the hearing
12one or more continuances.
SB331-SA4,2,3
12. If the hearing examiner grants the individual a 2nd continuance, all child
2care subsidy payments on behalf of the individual shall be suspended pending the
3final decision of the hearing examiner.
SB331-SA4,2,64 3. The hearing examiner shall render his or her final decision within 30 days
5after the individual filed the request for the hearing, regardless of whether the
6hearing examiner has granted one or more continuances.".
SB331-SA4,2,8 73. Page 24, line 1: delete "This act" and substitute "Except for the treatment
8of section 49.155 (5m) of the statutes, this act".
SB331-SA4,2,9 94. Page 24, line 7: after that line insert:
SB331-SA4,2,12 10"(1d) Wisconsin Shares administrative hearing. The treatment of section
1149.155 (5m) of the statutes first applies to hearing requests filed on the effective date
12of this subsection.".
SB331-SA4,2,13 135. Page 24, line 13: after that line insert:
SB331-SA4,2,16 14"(1d) Wisconsin Shares administrative hearing. The treatment of section
1549.155 (5m) of the statutes and Section 40 (1d) of this act take effect on the day after
16publication.".
