SENATE AMENDMENT 1, TO 2011 SENATE BILL 487

SB487-SA1,1,1 At the locations indicated, amend the bill as follows:

SB487-SA1,1,3 1. Page 4, line 8: delete "3rd party administrator" and substitute "3rd-party administrator".

SB487-SA1,1,4 2. Page 4, line 9: after that line insert:

SB487-SA1,1,5 " Section 13m. 49.475 (2m) of the statutes is created to read:

SB487-SA1,1,10 49.475 (2m) Limits on information to be provided. (a) The information that the department may request under this section is limited to the information specified in sub. (2) (a) and does not include an employer's name unless that information is necessary for the department or a provider to obtain 3rd-party payment for an item or service.

SB487-SA1,2,2 (b) If information under sub. (2) (a) may be available from more than one source that includes an employer operating a self-insured plan, the department shall seek the information first from a 3rd-party administrator or other entity identified in sub. (1) (f) 7. or pharmacy benefits manager before seeking the information from the employer.

SB487-SA1,2,5 (c) Information obtained under this section may be used only for the purposes specified in this section and in federal law on 3rd-party liability in Medical Assistance programs.

SB487-SA1, s. 14m Section 14m. Effective date.

SB487-SA1,2,8 (1) This act takes effect on the first day of the 7th month beginning after publication.".
