TO ASSEMBLY BILL 74

AB74-ASA2,1,2 1An Act to amend 20.455 (5) (g); and to create 814.75 (8r), 814.76 (5m) and
2973.0455 of the statutes; relating to: creating a victims of crime surcharge.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB74-ASA2,1 3Section 1. 20.455 (5) (g) of the statutes, as affected by 2013 Wisconsin Act 20,
4is amended to read:
AB74-ASA2,1,115 20.455 (5) (g) Crime victim and witness assistance surcharge and victims of
6crime surcharge
, general services. The amounts in the schedule for purposes of ch.
7950. All moneys received from any crime victim and witness assistance surcharge
8authorized under s. 973.045 (1) or (1m), all moneys received from any victims of crime
9surcharge authorized under s. 973.0455,
and all moneys received from any
10delinquency victim and witness assistance surcharge authorized under s. 938.34 (8d)
11(a) shall be credited to this appropriation account.

1Section 2. 814.75 (8r) of the statutes is created to read:
AB74-ASA2,2,22 814.75 (8r) The victims of crime surcharge under s. 973.0455.
AB74-ASA2,3 3Section 3. 814.76 (5m) of the statutes is created to read:
AB74-ASA2,2,44 814.76 (5m) The victims of crime surcharge under s. 973.0455.
AB74-ASA2,4 5Section 4. 973.0455 of the statutes is created to read:
AB74-ASA2,2,9 6973.0455 Victims of crime surcharge. (1) If a court imposes a sentence or
7places a person on probation, the court shall impose a victims of crime surcharge.
8The surcharge is the total amount calculated by adding up, for each misdemeanor
9or felony count on which a conviction occurred, $20.
AB74-ASA2,2,13 10(2) After determining the amount due, the clerk of court shall collect and
11transmit the amount to the county treasurer under s. 59.40 (2) (m). The county
12treasurer shall then make payment to the secretary of administration under s. 59.25
13(3) (f) 2.
AB74-ASA2,2,15 14(3) The secretary of administration shall credit the surcharge to the
15appropriation account under s. 20.455 (5) (g).
AB74-ASA2,5 16Section 5. Initial applicability.
AB74-ASA2,2,1817 (1) This act first applies to a person who is sentenced or placed on probation for
18an offence committed on the effective date of this subsection.
