AB366-ASA1-AA1,1,11 At the locations indicated, amend the substitute amendment as follows:
AB366-ASA1-AA1,1,3 21. Page 3, line 23: delete "No" and substitute "Except as provided under par.
3(g), no".
AB366-ASA1-AA1,1,4 42. Page 5, line 2: after that line insert:
AB366-ASA1-AA1,1,8 5"(g) A pain clinic at which health care providers do not regularly prescribe
6monitored prescription drugs, as defined in s. 961.385 (1) (ag), to a patient for more
7than 90 days in a 12-month period is not required to obtain a certificate to operate
8under this subsection.".
AB366-ASA1-AA1,1,9 93. Page 5, line 13: delete lines 13 to 18 and substitute:
AB366-ASA1-AA1,2,2 10"(3) Payment method. (a) In this subsection, "traceable" means capable of
11allowing a person to ascertain, retain, and verify personally identifiable information,

1including, at a minimum, the first and last name, home address, and date of birth,
2of a payer in connection with a payment.
AB366-ASA1-AA1,2,83 (b) A pain clinic may only accept payment by insurance coverage, credit, a
4credit card, a check, a draft, or another form of payment that is traceable to the
5individual seeking treatment at the pain clinic and shall retain records of payment.
6An individual seeking treatment for which a claim is submitted to an insurance
7company may pay to the pain clinic any insurance copayment, coinsurance, or
8deductible with cash or another payment method that is not traceable.".
AB366-ASA1-AA1,2,12 94. Page 6, line 8: delete the material beginning with "health care" and ending
10with "billing" on line 11 and substitute "the medical examining board, may
11promulgate rules to govern the operation of pain clinics as the department finds
12necessary to provide safety to the public".
