AB1041,1,4 1An Act to repeal 20.370 (5) (cz); to amend 27.016 (5) and 27.016 (7); and to

20.370 (5) (cz) and 27.016 (8) of the statutes; relating to: expenditures
3from the heritage state parks and forests trust fund, a grant to Shawano County
4for surfacing the Mountain Bay trail and making an appropriation.
Analysis by the Legislative Reference Bureau
Under current law, the department of natural resources may award matching
grants to groups that are established for the benefit of state parks, state forests in
the southern part of the state and state recreation areas. Funding for these grants
comes from the heritage state parks and forests trust fund (heritage fund), which is
a nonlapsible trust fund consisting of gifts and contributions made to the fund and
moneys received from the sale of utility easements in state parks, southern state
forests and state recreation areas. Under current law, for a group to be eligible for
grant, it must have established an endowment fund for the park, forest or recreation
area and may only use the interest generated from the endowment fund as matching
funds for the grant. This bill eliminates the requirement that the matching funds
be limited to the interest generated. The bill also requires that the cash balance in
the heritage fund not go below $100,000.
The bill also provides a grant of $280,000 from the heritage fund in fiscal year
1996-97 to Shawano County for surfacing the Mountain Bay trail.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB1041, s. 4 9Section 4. 27.016 (5) of the statutes, as created by 1995 Wisconsin Act 27, is
10amended to read:
AB1041,2,1711 27.016 (5) The amount of a grant under this section shall equal 50% of the
12amount of matching funds that are provided by the friends group for the grant. A
13friends group may only use the interest generated by the endowment fund for
14purposes of providing the matching funds.
The matching funds and the grant may
15be used only for the operation and maintenance of the state park, southern state
16forest or state recreation area that the friends group's endowment fund was
17established to benefit.

127.016 (7) Beginning in fiscal year 1996-97 and for each fiscal year thereafter,
2except as provided in sub. (8), any moneys not encumbered or expended for grants
3under sub. (6) from the appropriation under s. 20.370 (1) (eq) may be used expended
4by the department for the operation and maintenance of the state parks, of the
5southern state forests and of state recreation areas.

8moneys from the appropriation under s. 20.370 (1) (eq) for grants under sub. (6) or
9for the operation and maintenance of state parks, of southern state forests or of state
10recreation areas if the expenditure will result in the heritage state parks and forests
11trust fund having an unencumbered balance of less than $100,000 on June 30, 1997,
12or on any June 30 thereafter.

AB1041,3,26 23(1) From the appropriation under section 20.370 (5) (cz) of the statutes, as
24created by this act, the department of natural resources shall provide to Shawano
25County in fiscal year 1996-97 a grant of not more than $280,000 for surfacing the
26Mountain Bay trail.

1Section 9. Effective dates. This act takes effect on July 1, 1996, except as
2follows:

41997.
