AB127,1,3 1An Act to renumber 118.19 (1); to amend 118.195 (1), 119.32 (1) and 121.02 (1)
2(a) 1.; and to create 118.19 (1) (b) of the statutes; relating to: the licensure of
3school district administrators and business managers.

Under current law, every teacher, administrator and professional staff member
employed by a school board, other than the board of the Milwaukee Public Schools
(MPS), must hold the appropriate license issued by the state superintendent of
public instruction. In MPS, prior to July 1, 1999, the board may appoint a
superintendent of schools who is not licensed by the state superintendent.
This bill provides that if a school board employs both a school district
administrator and a business manager, only one is required to be licensed by the
state superintendent. In MPS, the bill provides that prior to July 1, 1999, the board
may appoint a superintendent who is not licensed by the state superintendent even
if a business manager employed by the board is not licensed by the state
superintendent.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB127, s. 1 4Section 1. 118.19 (1) of the statutes is renumbered 118.19 (1) (a).
AB127, s. 2 5Section 2. 118.19 (1) (b) of the statutes is created to read:

1118.19 (1) (b) Notwithstanding par. (a), if a school board employs both a school
2district administrator and a business manager, only one is required to hold a license
3issued by the state superintendent.
AB127, s. 3 4Section 3. 118.195 (1) of the statutes is amended to read:
AB127,2,95 118.195 (1) No person otherwise qualified may be denied a certificate or license
6from the state superintendent under s. 118.19 (1) (a) because the person is totally or
7partially blind, deaf or physically handicapped nor may any school district refuse to
8employ a teacher on such grounds, if such handicapped teacher is able to carry out
9the duties of the position which the person seeks.
AB127, s. 4 10Section 4. 119.32 (1) of the statutes is amended to read:
AB127,2,1811 119.32 (1) The board shall elect by roll call vote at a regular meeting a
12superintendent of schools whenever that office becomes vacant. The superintendent
13of schools shall be a person of suitable learning and experience in the art of
14instruction and shall have practical familiarity with the most approved methods of
15organizing and conducting a system of schools. Notwithstanding ss. 115.28 (7),
16118.19 (1) and 121.02 (1) (a), prior to July 1, 1999, the board may elect a
17superintendent of schools who is not licensed or certified by the department even if
18a business manager employed by the board is not licensed by the department
.
AB127, s. 5 19Section 5. 121.02 (1) (a) 1. of the statutes is amended to read:
AB127,2,2320 121.02 (1) (a) 1. Ensure Except as provided under s. 118.19 (1) (b), ensure that
21every teacher, supervisor, administrator and professional staff member holds a
22certificate, license or permit to teach issued by the department before entering on
23duties for such position.
