AB407,1,3 1An Act to create 453.07 (1m) of the statutes; relating to: physical, mental and
2professional competency examinations of credential holders subject to a
3disciplinary investigation or proceeding by the veterinary examining board.
Analysis by the Legislative Reference Bureau
Under current law, the veterinary examining board (board) may investigate
and prosecute unprofessional conduct by a person who has been issued a credential
by the board. This bill permits the board to require a credential holder who is being
investigated or prosecuted for unprofessional conduct to submit to one or more
physical, mental or professional competency examinations if the board believes that
the results of any such examination may be useful to the board in conducting its
investigation or prosecution.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB407, s. 1 4Section 1. 453.07 (1m) of the statutes is created to read:
AB407,2,35 453.07 (1m) (a) When investigating allegations of unprofessional conduct by
6a person holding a license, permit or certificate issued by the examining board, the
7examining board may require the person to undergo one or more physical, mental or
8professional competency examinations if the examining board believes that the

1results of any such examination may be useful to the board in conducting its
2investigation. The examining board may consider the results of any such
3examination in conducting its investigation.
AB407,2,144 (b) If the examining board begins disciplinary proceedings against a person
5holding a license, permit or certificate issued by the examining board, the examining
6board may consider at any time during the proceeding the results of any physical,
7mental or professional competency examination of the person that was required
8under par. (a). If the person was not required to undergo a physical, mental or
9professional competency examination under par. (a), the examining board may
10require the person to undergo one or more such examinations while the disciplinary
11proceeding is pending and may use the results of any such examination during the
12disciplinary proceeding if the examining board believes that the results of the
13examination may be useful to the examining board in conducting the disciplinary
14proceeding.
AB407, s. 2 15Section 2. Initial applicability.
AB407,2,18 16(1)   This act first applies to disciplinary investigations of and disciplinary
17proceedings against a person granted a credential under chapter 453 of the statutes
18that begin on the effective date of this subsection.
