AB450,1,2 1An Act to create 95.60 of the statutes; relating to: testing cow's milk before
2certain auctions and providing notice concerning the test results.
Analysis by the Legislative Reference Bureau
With certain exceptions, this bill requires a person selling a dairy cow at auction
to have one of 2 specified tests conducted on the cow's milk before the auction. If the
test indicates a somatic cell count of 1,000,000 or more per milliliter, the person must
so inform the auctioneer. If the auctioneer is informed of such a test result, he or she
must announce the test result immediately before selling the cow. These
requirements do not apply to the sale of a dairy cow at a livestock market or by a
livestock dealer.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB450, s. 1 3Section 1. 95.60 of the statutes is created to read:
AB450,1,6 495.60 Testing milk before certain auctions. (1) Except as provided in sub.
5(3), a person who owns a dairy cow that is producing milk may not sell the dairy cow
6at auction unless one of the following applies:
AB450,2,27 (a) Within 24 hours before the auction a veterinarian has performed a separate
8California mastitis test on a sample of milk from each of the dairy cow's teats and,
9if any of the samples produces a positive reaction indicating a somatic cell count of

11,000,000 or more per milliliter, the person informs the auctioneer of the results of
2the test before the auction.
AB450,2,63 (b) No earlier than the 10th day before the day of the auction a dairy herd
4improvement association (DHIA) test has been performed on the dairy cow's milk
5and, if the test indicates a somatic cell count of 1,000,000 or more per milliliter, the
6person informs the auctioneer of the results of the test before the auction.
AB450,2,8 7(2) An auctioneer who is informed of the results of a test under sub. (1) (a) or
8(b) shall announce the results of the test immediately before selling the dairy cow.
AB450,2,10 9(3) Subsection (1) does not apply to the sale of a dairy cow at a livestock market,
10as defined in s. 95.68 (1) (e) or by a livestock dealer, as defined in s. 95.69 (1) (c).
