AB486,1,2 1An Act to amend 250.02 (1) of the statutes; relating to: qualifications of the
2state health officer.
Analysis by the Legislative Reference Bureau
Under current law, the secretary of health and social services is required to
appoint a state health officer and may assign that state health officer duties of the
secretary or the department of health and social services. The state health officer
is authorized to appoint advisory and examining bodies and to appoint state
epidemiologists for program areas of acute and communicable diseases, occupational
and environmental diseases, maternal and child health and chronic diseases. Also
under current law, county boards in counties with a population of less than 500,000
are required to establish county health departments at one of 3 levels of service, with
local health officers whose qualifications are specified commensurate with the level
of service established for the county health department. (In Milwaukee County, the
governing body of each city or village is required to establish city or village health
departments at one of the 3 levels of service, with the same commensurate
requirements for local health officers.) A local health officer of a Level III local health
department is required to have at least one of the following:
1. A master's degree in public health, public administration, health
administration or a similar field and 3 years of experience in a full-time
administrative position in a public health agency or in public health work.
2. A bachelor's degree and 16 graduate semester credits towards a master's
degree in public health, public administration, health administration or a similar
field and 5 years of experience.
3. A license to practice medicine and surgery, together with at least 3 years of
experience in a full-time administrative position in a public health agency or in
public health work, or eligibility for certification by the American Board of
Preventive Medicine in public health or general preventive medicine, or a master's
degree in public health, public administration, health administration or a similar
field.

This bill requires that the person who is appointed by the secretary of health
and social services as state health officer have qualifications that are equal to those
required for a local health officer in a Level III local health department. The bill first
applies to a person who is first appointed as the state health officer after the bill
becomes law.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB486, s. 1 1Section 1. 250.02 (1) of the statutes is amended to read:
AB486,2,122 250.02 (1) State health officer; duties. The secretary shall appoint a state
3health officer and may assign the state health officer such duties of the secretary or
4department as the secretary provides. The state health officer shall have
5qualifications that equal those required of a local health officer under s. 251.06 (1)
6(c).
The state health officer may appoint such advisory and examining bodies as are
7needed to carry out the duties of the state health officer and as provided by law. The
8state health officer shall appoint state epidemiologists for program areas of acute
9and communicable diseases, occupational and environmental diseases, maternal
10and child health and chronic diseases. Individuals appointed as state
11epidemiologists shall have advanced training and expertise in epidemiology in their
12program areas.

AB486,2,15 14(1)  This act first applies to an individual who is appointed as state health
15officer on the effective date of this subsection.
