AB641,1,3 An Act to amend 343.30 (1n), 346.60 (2) (a), 349.11 (2) (a), 349.11 (8) (intro.) and 349.11 (8m) (a); and to create 346.57 (4) (gb) of the statutes; relating to: motor vehicle maximum speed limits.

Analysis by the Legislative Reference Bureau

Under current law, no person may drive a motor vehicle faster than the maximum speed limit provided by law. Current law provides for a maximum speed limit of 65 miles per hour on any freeway for which federal law provides for a maximum speed limit of 65 miles per hour, and a maximum speed limit of 55 miles per hour unless a different speed limit is provided by law and posted by official signs. This bill raises the maximum speed limit on certain freeways and expressways to 65 miles per hour.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB641, s. 1 Section 1. 343.30 (1n) of the statutes is amended to read:

AB641,2,5 343.30 (1n) A court shall suspend the operating privilege of a person for a period of 15 days upon the person's conviction by the court of exceeding the applicable speed limit as established by s. 346.57 (4) (gb), (gm) or (h), by 25 or more miles per hour. If the conviction makes the person subject to revocation under s. 343.32 or suspension or revocation under s. 343.085, the court shall immediately suspend the license, taking possession of the license and shall forward it to the department which shall proceed to act as authorized under s. 343.32 or 343.085, but any revocation or suspension by the secretary shall date from the day the court took possession of the license.

AB641, s. 2 Section 2. 346.57 (4) (gb) of the statutes is created to read:

AB641,2,9 346.57 (4) (gb) 65 miles per hour on any expressway or freeway having 2 or more lanes of travel in each direction. This paragraph does not apply to a freeway for which a limit of 65 miles per hour has been determined under par. (gm).

AB641, s. 3 Section 3. 346.60 (2) (a) of the statutes is amended to read:

AB641,2,13 346.60 (2) (a) Except as provided in sub. (3m) or (5), any person violating s. 346.57 (4) (d) to (g) (gb) or (h) or (5) or 346.58 may be required to forfeit not less than $30 nor more than $300.

AB641, s. 4 Section 4. 349.11 (2) (a) of the statutes is amended to read:

AB641,2,16 349.11 (2) (a) Declare a speed limit which is in excess of the limits stated in s. 346.57 (4) (h), except as provided in s. 346.57 (4) (gb) or (gm); or

AB641, s. 5 Section 5. 349.11 (8) (intro.) of the statutes is amended to read:

AB641,2,20 349.11 (8) (intro.)  Notwithstanding the authority otherwise granted to modify speed restrictions in this section, except as provided in sub. (9) and s. 346.57 (4) (gb) or (gm), the department may not establish or continue:

AB641, s. 6 Section 6. 349.11 (8m) (a) of the statutes is amended to read:

AB641,2,24 349.11 (8m) (a) A Except as provided in s. 346.57 (4) (gb), a maximum speed limit on any highway within their respective jurisdictions in excess of 55 miles per hour;.
