AB849,1,3 1An Act to amend 343.16 (2) (c) of the statutes; relating to: the method of
2reviewing and establishing revised operator's license examination standards
3and granting rule-making authority.

Current law requires the department of transportation to develop new and
revised standards to govern driver's license examinations and reexaminations,
taking into consideration any federal standards or requirements which may apply,
and requires that a public hearing be held to consider the revised standards before
a joint session of the senate and assembly committees having jurisdiction over
transportation matters. The revised standards may take effect only upon approval
of those standards as a joint resolution.
This bill eliminates the requirement that the revised standards be considered
before a joint session of the senate and assembly committees having jurisdiction over
transportation matters. The bill also eliminates the requirement that a joint
resolution approving the revised standards be adopted for such standards to take
effect, and requires instead the promulgation of such standards by rule.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB849,2,65 343.16 (2) (c) Standards. The secretary department shall develop new and

promulgate rules setting standards to govern driver license examinations
7and reexaminations, taking. Such standards shall take into consideration any

1federal standards or requirements which may apply. A public hearing shall be held
2before a joint session of the senate and assembly committees having jurisdiction over
3transportation matters, as determined by the speaker of the assembly and the
4president of the senate, to review such proposed standards. Such standards shall
5enter into effect only upon approval as a joint resolution by a majority of the members
6of the assembly and of the senate.
