AB85,1,4 1An Act to amend 343.14 (2) (b) and 343.50 (4); and to create 343.14 (2g) of the
2statutes; relating to: the furnishing of social security numbers on applications
3for licenses and identification cards issued by the department of transportation
4and granting rule-making authority.
Analysis by the Legislative Reference Bureau
Under current law, any application for an operator's license or identification
card issued by the department of transportation (DOT) must include the applicant's
social security number. This bill provides a waiver from this requirement for an
applicant on the ground that furnishing his or her social security number conflicts
with the applicant's deeply held convictions. The bill requires DOT to promulgate
rules governing eligibility for the waiver.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB85, s. 1 5Section 1. 343.14 (2) (b) of the statutes is amended to read:
AB85,1,86 343.14 (2) (b) The applicant's date of birth, social security number, color of eyes,
7color of hair, sex, height, weight and, race and, except as provided in sub. (2g), social
8security number

AB85, s. 2 9Section 2. 343.14 (2g) of the statutes is created to read:

1343.14 (2g) (a) The department shall waive the requirement of furnishing a
2social security number for an applicant, licensee or identification card holder who
3requests a waiver on the ground that the requirement conflicts with deeply held
4convictions of the applicant, licensee or identification card holder. The department
5shall promulgate rules governing eligibility for the waiver under this paragraph.
AB85,2,116 (b) The forms for application for a license or identification card or for renewal
7thereof or another form provided by the department shall include a place for an
8applicant, licensee or identification card holder to request a waiver from the
9requirement of furnishing his or her social security number on the ground that the
10requirement conflicts with deeply held convictions of the applicant, licensee or
11identification card holder.
AB85, s. 3 12Section 3. 343.50 (4) of the statutes is amended to read:
AB85,2,2113 343.50 (4) Application. The application for an identification card shall include
14the information required under s. 343.14 (2) (a) and (b), (2g) and (2m), such further
15information as the department may reasonably require to enable it to determine
16whether the applicant is entitled by law to an identification card and, for applicants
17who are aged 65 years or older, material, as provided by the department, explaining
18the voluntary program that is specified in s. 71.55 (10) (b). The department shall,
19as part of the application process, take a photograph of the applicant to comply with
20sub. (3). No application may be processed without the photograph being taken.
21Misrepresentations are punishable as provided in s. 343.14 (5).
AB85, s. 4 22Section 4. Effective date.
AB85,2,24 23(1) This act takes effect on the first day of the 6th month beginning after
24publication.
