AB891,1,2 1An Act to create 50.04 (2s) of the statutes; relating to: requiring nursing homes
2to maintain temperatures below a specified maximum temperature.

Under current law, nursing homes are required to comply with special laws
relating to their regulation, including requirements as to personnel, plans of care
and patient assessment and the posting of certain notices. Violations of these laws
subject nursing homes to various sanctions and penalties, including issuance of
corrections orders, service of a notice of violation, request for a plan of correction and
imposition of forfeitures by the department of health and social services.
This bill expands the special laws relating to regulation of nursing homes to
require that a nursing home maintain a temperature of not more than 82 degrees
Fahrenheit in any area of the nursing home that is used by a person who is cared for
or treated in the nursing home.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB891, s. 1 3Section 1. 50.04 (2s) of the statutes is created to read:
AB891,1,64 50.04 (2s) Temperature limit. A nursing home shall maintain a temperature
5that does not exceed 82 degrees Fahrenheit in any area of the nursing home that is
6used by a resident.
