1An Act to repeal 46.031 (3), 46.30 (3) (a) 8. and 301.031 (3) of the statutes;
2relating to: elimination of the requirement for public participation by a citizen
3advisory committee or by an alternate process in the formulation of budgets for
4services provided or purchased by county departments of social services,
5human services, developmental disabilities services and community programs.
Analysis by the Legislative Reference Bureau
Under current law, before a county department of social services, human
services, developmental disabilities services or community programs (county
department) develops and submits a proposed budget to the county executive or
county administrator or to the county board of supervisors, the county department
must assess needs and inventory resources and services by use of an open public
participation process. As part of this process, a citizen advisory committee that is
established by the county board of supervisors must advise in the formulation of the
budget. However, if the department of health and social services (DHSS) approves
a report that is submitted to DHSS by a county board of supervisors on an open public
participation process that is used to assess needs and inventory resources and
services, the citizen advisory committee need not be established. Each county
department must, by December 31 annually, submit the county department's final
budget to DHSS. DHSS, in turn, must, by May 1 annually, submit to county
departments a model of a proposed written contract containing the allocation of
funds and administrative requirements, and must, annually, submit the final
contract to each county board of supervisors for approval. Membership on citizen
advisory committees, as appointed by the county boards of supervisors, must include
representatives of persons receiving services, service providers and citizens, and a
member of the governing or administrative board of the community action agency
that serves the county, if any, and may not consist of more than 25% county
supervisors nor of more than 20% service providers.
Under current law as affected by
1995 Wisconsin Act 27 (the biennial budget
act), beginning on July 1, 1996, the same open public participation process, by use
of a citizen advisory committee or, alternatively, by use of a report on the process, is
required of county departments of social services or human services for budget
submittal to the department of corrections (DOC) for services directly provided or
purchased. The citizen advisory committee that is required for submittal of budgets
to the department of health and family services (DHFS) (formerly DHSS) may also
serve as the citizen advisory committee that is required for submittal of budgets to
DOC.
This bill, beginning on July 1, 1996, eliminates the requirements that a county
board of supervisors establish a citizen advisory committee to advise a county
department in the formulation of its budget for services for submittal to DHFS and
DOC or, alternatively, that a county board of supervisors submit to DHFS and DOC
for approval a report on the open public participation process used.
