AB991,1,4 An Act to amend 29.09 (9m) (a) 1m., 29.09 (9m) (b) and 29.092 (13m) (a); and to create 29.092 (2) (ky), 29.092 (13m) (am) and 29.1075 (1m) of the statutes; relating to: issuing bonus deer hunting permits to certain landowners and granting rule-making authority.

Analysis by the Legislative Reference Bureau

Under current law, the department of natural resources (DNR) may issue bonus deer hunting permits to residents and nonresidents who hold licenses that authorize the hunting of deer. This allows the holder to kill an additional deer of the sex or type authorized by DNR. Under current law, applicants for these permits must pay a fee for the permit, plus an application processing fee. Under this bill, if DNR determines that the number of bonus deer hunting permits available for a deer management area will exceed the number of applications submitted for the permits, DNR by rule may authorize the issuance of bonus deer hunting permits for free to residents of this state who own at least 100 acres of land that are located in whole or in part in the deer management area.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB991, s. 1 Section 1. 29.09 (9m) (a) 1m. of the statutes, as created by 1995 Wisconsin Act 27, is amended to read:

AB991,2,2 29.09 (9m) (a) 1m. Bonus deer hunting permit , unless issued under s. 29.1075 (1m).

AB991, s. 2 Section 2. 29.09 (9m) (b) of the statutes, as created by 1995 Wisconsin Act 27, is amended to read:

AB991,2,16 29.09 (9m) (b) If a person applies jointly for a hunter's choice deer hunting permit and a bonus deer hunting permit, the person shall pay a single processing fee. A person who applies for a bonus deer hunting permit is exempt from paying an additional processing fee if the person has already applied for a hunter's choice deer hunting permit for the same season. If the department authorizes the issuing of more than one bonus deer hunting permit to a person in a single season under s. 29.1075 (2), the person is exempt from paying an additional processing fee for an application for the 2nd or subsequent bonus deer hunting permit. If the department authorizes the issuing of more than one bonus deer hunting permit to a person in a single season under s. 29.1075 (2), the person is exempt from paying an additional processing fee for an application for any of the bonus deer hunting permits if the person is exempted from the application fee under s. 29.09 (9m) (a) 1m.

AB991, s. 3 Section 3. 29.092 (2) (ky) of the statutes is created to read:

AB991,2,20 29.092 (2) (ky) Resident landowner bonus deer hunting permit. There is no fee for a bonus deer hunting permit issued to a resident landowner under s. 29.1075 (1m).

AB991, s. 4 Section 4. 29.092 (13m) (a) of the statutes, as affected by 1995 Wisconsin Act 27, is amended to read:

AB991,3,2 29.092 (13m) (a) The Except as provided in par. (am), the processing fee for an application for a hunter's choice deer hunting permit, a bonus deer hunting permit, a wild turkey hunting license, a Canada goose hunting permit, a bobcat hunting and trapping permit, an otter trapping permit or a fisher trapping permit is $2.75.

AB991, s. 5 Section 5. 29.092 (13m) (am) of the statutes is created to read:

AB991,3,5 29.092 (13m) (am) There is no processing fee for a bonus deer hunting permit issued to a resident landowner under s. 29.1075 (1m).

AB991, s. 6 Section 6. 29.1075 (1m) of the statutes is created to read:

AB991,3,12 29.1075 (1m) Resident landowners. (a) If the department determines that for a deer management area the number of available bonus deer hunting permits will exceed the number of applications submitted, the department may authorize by rule the issuance of one or more bonus deer hunting permits to residents who qualify under par. (b) without the residents having to pay any fee, including any processing fee.

AB991,3,15 (b) A resident qualifies under par. (a) if the resident is an owner of record or a vendee under a land contract of at least 100 acres in one parcel that is located in whole or in part in the deer management area.
