AB993,1,3 1An Act to repeal 346.925 (3); to amend 346.95 (4) and 346.95 (4); and to create
2346.925 (3) of the statutes; relating to: penalties for the operation of
3agricultural machinery upon a highway by uncertified youthful operators.
Analysis by the Legislative Reference Bureau
Under current law, beginning on May 1, 1996, no person may allow a child
under 16 years of age to operate a farm tractor (or other self-propelled implement
of husbandry) on a highway unless the child has successfully completed an approved
tractor and machinery operation safety course. A person who violates this
prohibition may be required to forfeit not more than $20 for a first violation or not
more than $50 for a 2nd or subsequent offense.
This bill delays the date on which these penalties first apply until July 1, 1997.
Until that time, there is no penalty for a violation of this prohibition.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB993, s. 1 4Section 1. 346.925 (3) of the statutes is created to read:
AB993,1,65 346.925 (3) Notwithstanding s. 939.61, no penalty may be imposed for a
6violation of this section.
AB993, s. 2 7Section 2. 346.925 (3) of the statutes, as created by 1995 Wisconsin Act .... (this
8act), is repealed.
AB993, s. 3 9Section 3. 346.95 (4) of the statutes is amended to read:

1346.95 (4) Any person violating s. 346.925 or 346.94 (8) or (8m) may be required

5act), is amended to read:

11applies to the operation of agricultural machinery on July 1, 1997.
AB993, s. 6 12Section 6. Effective dates. This act takes effect on the day after
13publication, except as follows:
AB993,2,15 14(1) The repeal of section 346.925 (3) of the statutes and the amendment of
15346.95 (4) (by Section (4 )) of the statutes take effect on July 1, 1997.
