SB109,1,3 1An Act to amend 38.24 (2); and to create 38.04 (27) and 38.24 (1m) (e) of the
2statutes; relating to: establishing a statewide technical college system
3student government and granting rule-making authority.

This bill requires the state technical college system board to provide for a
biennial election to be held in each technical college district to determine whether
the students wish to participate in statewide student government and to choose the
organization to represent those students. The bill directs the state board to establish
a uniform fee for all students who are subject to student activity fees for the support
of student government.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB109, s. 1 4Section 1. 38.04 (27) of the statutes is created to read:
SB109,1,95 38.04 (27) Student government. (a) The board shall promulgate rules,
6applicable to all district boards, providing for an election to be held biennially in each
7district to determine whether the students enrolled in that district wish to
8participate in statewide student government and to choose the organization to
9represent those students.

1(b) With the approval of the board, the organization chosen under par. (a) shall
2establish a method for refunding the fees paid under s. 38.24 (1m) (e) by students who
3do not wish to contribute to statewide student government.
SB109, s. 2 4Section 2. 38.24 (1m) (e) of the statutes is created to read:
SB109,2,105 38.24 (1m) (e) Student government. Uniform fees for the support of the student
6government organization chosen under s. 38.04 (27) (a). All students who are subject
7to student activity and incidental fees established under s. 38.14 (9) are subject to
8the fee established under this paragraph except that the district board of a district
9in which the students vote not to participate in statewide student government under
10s. 38.04 (27) (a) shall not charge the fee established under this paragraph.
SB109, s. 3 11Section 3. 38.24 (2) of the statutes is amended to read:
SB109,2,1312 38.24 (2) Refunds. The Except as provided under s. 38.04 (27) (b), the board
13shall establish fee and tuition refund policies.
SB109, s. 4 14Section 4. Initial applicability.
SB109,2,17 15(1)  The treatment of section 38.24 (1m) (e) of the statutes first applies to the
16first semester that begins after the first election held under section 38.04 (27) (a) of
17the statutes, as created by this act.
