SB257,1,2 1An Act to amend 103.26 (2) and 103.72 (2) of the statutes; relating to:
2revocation of a child's work permit.

Under current law, subject to certain exceptions, before a child may be
employed, the department of industry, labor and human relations (DILHR) or a
permit officer designated by DILHR, ordinarily a school board, must issue a work
permit authorizing the child to work. Currently, DILHR, but not a permit officer,
may revoke a child's work permit if the permit has been improperly or illegally issued
or if the physical or moral welfare of the child would be best served by the revocation
of the permit. This bill permits a permit officer to revoke a child's work permit.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB257, s. 1 3Section 1. 103.26 (2) of the statutes is amended to read:
SB257,2,64 103.26 (2) The department or permit officer may revoke a street trade permit
5and identification card if the minor for whom such the permit was issued is found by
6the department or permit officer to have worked when prohibited under s. 103.24,
7if it appears to the department or permit officer that such the permit was improperly
8or illegally issued or if in their the judgment of the department or permit officer the

1best interests of the minor would be served by such the revocation. The department
2or permit officer shall by registered mail notify such the minor and the minor's
3employer of such revocation. On receipt of such the notice the employer shall
4immediately return the revoked permit and discontinue the employment of such the
5minor, and the minor shall immediately return the revoked identification card to the
6department or permit officer.
SB257, s. 2 7Section 2. 103.72 (2) of the statutes is amended to read:
SB257,2,168 103.72 (2) Whenever it shall appear appears to the department or permit
9officer
that any permit has been improperly or illegally issued, or that the physical
10or moral welfare of the minor would be best served by the revocation of the permit,
11the department or permit officer may forthwith immediately, without notice, revoke
12the same permit, and shall by registered mail notify the person employing such the
13minor and the minor holding such the permit of such the revocation. Upon receipt
14of such the notice, the employer employing such the minor shall forthwith
15immediately return the revoked permit to the department or permit officer and
16discontinue the employment of the minor.
