2edibles.

Current law prohibits a person from putting foreign objects in candy or other
edibles. In State v. Timm, 163 Wis. 2d 894 (Ct. App. 1991), the court of appeals
determined that "other edibles" covers "liquid edibles, as well as solid edibles". This
bill codifies that decision.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Law revision committee prefatory note: This bill is introduced by the law revision
committee under s. 13.83 (1) (c) 1., stats. After careful consideration of the court of
appeals decision in State v. Timm, 163 Wis. 2d 894 (Ct. App. 1991), the law revision
committee has determined that codifying that decision is desirable as a matter of public
policy.
SB294, s. 1 3Section 1. 941.325 of the statutes is amended to read:
SB294,1,6 4941.325 Placing foreign objects in edibles. Whoever places objects, drugs
5or other substances in candy or other liquid or solid edibles with the intent to cause
6bodily harm to another person is guilty of a Class E felony.
Note: This bill clarifies that placement of foreign objects in both liquid and solid
edibles is a crime under this statute.
