SB346,1,2 1An Act to amend 121.51 (1) of the statutes; relating to: the attendance areas
2of private schools for pupil transportation purposes.

Under current law, a school district must provide transportation to and from
school for each pupil residing in the school district who attends a private school
located 2 miles or more from the pupil's residence if the pupil resides within the
private school's attendance area and the private school is situated within the school
district or not more than 5 miles beyond the boundaries of the school district. An
"attendance area" is the geographic area designated by the governing body of a
private school as the area from which its pupils attend and approved by the school
board of the school district in which the private school is located. With certain
exceptions, the attendance areas of private schools affiliated with the same religious
denomination may not overlap.
This bill provides that with certain exceptions, the attendance areas of private
schools affiliated with the same denomination that are located within the same
school district may not overlap.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB346, s. 1 3Section 1. 121.51 (1) of the statutes is amended to read:
SB346,2,84 121.51 (1) "Attendance area" is the geographic area designated by the
5governing body of a private school as the area from which its pupils attend and

1approved by the school board of the district in which the private school is located.
2If the private school and the school board cannot agree on the attendance area, the
3state superintendent shall, upon the request of the private school and the board,
4make a final determination of the attendance area. The attendance areas of private
5schools affiliated with the same religious denomination that are located within the
6same school district
shall not overlap unless one school limits its enrollment to pupils
7of the same sex and the other school limits its enrollment to pupils of the opposite sex
8or admits pupils of both sexes.
