SB465,1,4 1An Act to amend 20.255 (2) (fi) (title), 115.28 (25), 115.363 (1) (d) and 115.363
2(6) of the statutes; relating to: grants to school districts to provide services to
3limited-English speaking pupils from Southeast Asian language groups
4(suggested as remedial legislation by the department of public instruction).
Analysis by the Legislative Reference Bureau
Under current law, a school board may apply to the state superintendent of
public instruction for a grant to develop one of a number of learning assistance
programs, including a program designed to provide services to limited-English
speaking pupils from Indo-Chinese language groups. In the 1989-90 and 1990-91
school years, the state superintendent was directed to allocate $434,000 for learning
assistance program grants to school districts with enrollments of less than 12,000 in
which more than 3.5% of the enrollment consisted of limited-English speaking
pupils from Indo-Chinese language groups.
This bill changes the reference from "Indo-Chinese" language groups to
"Southeast Asian" language groups. The bill also directs the state superintendent
to allocate $434,000 annually for learning assistance program grants to school
districts with enrollments of less than 12,000 in which more than 3.5% of the
enrollment consists of limited-English speaking pupils from Southeast Asian
language groups.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

Law revision committee prefatory note: This bill is a remedial legislation
proposal, requested by the department of public instruction and introduced by the law
revision committee under s. 13.83 (1) (c) 4., stats. After careful consideration of the
various provisions of this bill, the law revision committee has determined that this bill
makes minor substantive changes in the statutes, and that these changes are desirable
as a matter of public policy.

Annually, award the amount appropriated under s. 20.255 (2) (fi)
6to a nonprofit organization located in a 1st class city to support the costs of bilingual
7personnel serving as liaisons between the Indo-Chinese Southeast Asian refugee
8community and the school district operating under ch. 119.

SB465,2,2213 115.363 (6) Amounts awarded under this section shall be paid from the
14appropriation under s. 20.255 (2) (ez) and may be paid in instalments. The Beginning
15in the 1995-96 school year, the
state superintendent shall annually allocate
16$434,000 in the 1989-90 school year and $434,000 in the 1990-91 school year for
17school districts with a membership of less than 12,000 in which more than 3.5% of
18the membership consists of limited-English speaking pupils from Indo-Chinese
19Southeast Asian language groups. Beginning in the 1992-93 school year and
20annually thereafter
Annually, the state superintendent shall allocate $1,000,000 for
21programs under sub. (1) (f). In this subsection, "membership" has the meaning given
22in s. 121.004 (5).

Note: These Sections substitute the term "Southeast Asian" for the inappropriate
and inaccurate term "Indo-Chinese" in the statutes relating to learning assistance
programs for limited-English speaking pupils in various school districts. The new term
more accurately reflects the geographic area from which the relevant population
originates.
