The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Prefatory note: This bill was prepared for the joint legislative council's special
committee on shared governmental services. Under current law, the state administers
a local roads improvement program to accelerate the improvement of seriously
deteriorating local roads by reimbursing counties, cities, villages and towns for the cost
of improving the roads. Generally, projects funded under the program on city, village and
town highways must be performed under contracts awarded on the basis of competitive
bids. However, if a city, village or town does not receive a responsible bid, it may contract
with a county for the improvement. This bill explicitly provides that counties may also
submit bids to perform improvements on city, village or town highways funded under the
local roads improvement program.
SB542, s. 1 3Section 1. 86.31 (2) (b) of the statutes is amended to read:
SB542,2,34 86.31 (2) (b) Except as provided in par. (d), improvements for highway
5construction projects funded under the program shall be under contracts. Such
6contracts shall be awarded on the basis of competitive bids and shall be awarded to

1the lowest responsible bidder. Counties may bid on improvements under this section.
2If a city, village or town does not receive a responsible bid for an improvement, the
3city, village or town may contract with a county for the improvement.
