SB642,1,4 1An Act to amend 196.02 (1), 196.491 (3) (d) (intro.) and 196.491 (3) (d) 2.; and
2to create 196.023 of the statutes; relating to: prohibiting any person from
3selling or offering to sell electricity to the public within the service territory of
4an electric utility.

Competition in the distribution of electricity at the retail level is often referred
to as "retail wheeling". This bill limits retail wheeling by providing that, if an electric
utility provides electric service, either directly or indirectly, to or for the public within
a service territory in this state, no other person may sell or offer to sell electricity to
the public located in that service territory. Under the bill, electric utility is defined
to include a public utility that distributes or furnishes electricity, as well as a
cooperative association that distributes or furnishes electricity at retail to its
members.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB642, s. 1 5Section 1. 196.50 (8) of the statutes is created to read:
SB642,1,76 196.50 (8) Retail wheeling. (a) In this subsection, "electric utility" means all

SB642,1,88 1. A public utility that distributes or furnishes electricity.

12. A cooperative association organized under ch. 185 for the purpose of
2distributing or furnishing electricity at retail to its members.
